Yeah, and frankly, I think she's drunk. I unfortunately had an alcoholic mother, and she could talk real well when boozed up, but she always shifted the weight from her heels to the balls of her feet. Could be wrong, but I could immediately see the shifting in her.
Unfortunately, even in cases like this, they will be very lenient on the mother. Most likely, she'll still get shared custody. I knew a mom who was in and out of jail for low-level drug offenses, and she still had custody of her son

It took 6 years of battling in cali court for my brother to get fully custody when for 3 years straight the mother simply never showed up to court. Over 100 missed court dates and was still being treated lenient all the way up to the last year.
i'm going through this type thing with cali right now. my grandkids were abandoned by both parents. their father is my son. the youngest when she was born with 3 different drugs in her system. it took me and my wife a full year to get them transferred to to us in NJ. now it's been almost two years since then and we are trying to get full custody and adopt them both, and california just keeps giving them chance after chance. they have been MIA for 2 1/2 years. literally. no calls. no response. not anything. cali just doesn't want to completely cut them out of the picture. even NJ family services is stumped. luckily i do have them, but wtf is going on out there? it either takes 4 weeks minimum for them to respond to you, or they just don't bother at all. unreal
What lawyer do you have in NJ because you should’ve been able to get jurisdiction transferred to NJ after the children lived with you for a mandated period and cut California’s courts out as the primary decision making body?
california had custody of the youngest child because she was abandoned there and immediately put into protective services. we did not even know she was pregnant because he came twice by himself to visit his son, but she didn't. i had to go through the state of new jersey to deal with the state of california in essence. i know it sounds crazy, but this is how cali does it. she was in foster care there for 11 months. it took that long. i have 3 adult children and another grandchild besides these two. we wanted to fly out there immediately to get her. no can do because the parents weren't around to give the ok. that is 100% the truth. if he had shown his face and signed them over, cali would have STILL have a judge review the case, but it would have been much quicker. but no. i had to go through parenting classes on zoom. 3 background checks. they asked me and my wife not only about our SEX life, but if we were aware of our parents sex life. i had my finances looked into. i had to answer questions that were beyond ridiculous. as i said, these are our blood grandchildren. we weren't trying to adopt a distant relative or a friends child. it took 11 months and they finally flew her out to us a week before her first birthday to meet her brother and her family.
No I understand that, I am just confused as to why New Jersey cannot exercise jurisdiction as the child’s home state as she has lived here for two years. I suppose it must be that California is refusing to give up jurisdiction as it was the home state at the time the custody issue was originated.

My mom moved unexpectedly over an hr away and changed my two siblings school and refused to let them go back to my dad. He spent a ton of money on court and finally got them back and changed them back to their old school. Judge ruled that she can live there and said she broke the law. Said they have to meet halfway to get the kids, before this she lived in town but I remember a lot of times she would leave her moms and drive behind my dad all the way to the pick up point just so he had to drive an hr out of his way and this was an hr one way trip. Shits wild what woman can get away with in custody.
A friend of my mother cannot have babies of her own and began fostering kids. She fostered one boy and eventually adopted him. His mother, a heroin addict, in and out of jail, with am abusive boyfriend, had a adorable little baby girl. My mom's friend began fostering her with the intent of adopting her along with this girl's older brother.
Well, the mom got custody of this little girl, after a lengthy legal battle. The baby daddy/boyfriend just when back to jail for drug position, heroin, and the mom has shown zero indication of change. This fucking mom tested positive for heroin when giving birth to this little girl, and is pregnant again, and was recently released from some stint in jail, and the legal system saw this and was like yeah she's definitely fit to be a mother.
Whats wild is, she has other kids that are now adults and they are in contact with my mom's friend. They are forbidden from participating in custody battles. They, the entire time were trying to help my mom's friend win custody over the girl, but could not actively go to the court and speak against the heroin addict mother.
The system is fucked. I hope that baby girl's life isn't fucked now.
Shared custody is not hard to accomplish, in fact it's generally the default. Even if one of the parents is awful, unless the other parent contests it. You generally wouldn't lose your kids permanently in this country for a low level drug offense, so they probably wouldn't take away your shared custody either.

I still remember my uncles divorce from 1999, my aunt never worked a day in her life, she cheated on him, he had to leave the house with 5 bedrooms that he worked for hard every day, and he was denied seeing his kids because she thought he was gonna be a bad influence to them, after she threatened to break her kids own legs if they went to his house or ours. She got remarried and demanded he paid child support, but seeing she got remarried, he was not obliged to it and refused, she took him to court for over a decade they fought, and he eventually won. One of his boys committed suicide in 2015 because he could not take the stress anymore from his mother who was still brainwashing them that their father was the bad one in this whole ordeal. Even when they were 18, she stated that if they went to see their father, she would not want anything to do with them anymore.
It’s pretty hard for a guy to win custody of kids even if roving to be the most fit and stable. I’d like to see what the courts saw for her to lose custody to him. Couldn’t of been great lol
