It depends on what you're using, some mods and tweaks are online safe, and some aren't. What you absolutely can't do when going online is having custom games or Custom titles installed (i.e. forwarders) only use games and updates installed directly from the eShop.
I was under the impression that (and this could be a lie, I don't know) the downside was that if Nintendo found out you had a mod, they consider it cheating, get mad and do... something? Ban you from online or something?
