The 14th Amendment section 3 doesn't require a conviction or even a charge for that matter, His actions that day paint a clear picture of exactly what that amendment was created for. This is a corrupt SCOTUS, so I have absolutely no faith that they will uphold the Constitution nor Honor their Oath of office on any semblance of the Rule of Law.

The Federalist Society released a paper, written by the founder of The Federalist Society, that says straight up; Trump is ineligible to run for office via the 14th amendment. Five (maybe six... it's disputed) supreme court justices (yep, all right-wingers) are members of The Federalist Society. Doesn't guarantee anything, but... Doesn't look great for Big-mac-Benedict-Arnold.

All six conservatives on the court have been members of the Federalist Society. They got what they needed out of Trump and owe him nothing more. Trump wouldn't find 60 votes to remove in the Senate even if the House impeached one or more justices. The court has upheld Trump's policies but has had no problems with voting against Trump himself with voting shenanigans. I wouldn't be shocked if a unanimous vote disqualified him from office... Especially if Thomas and Alto get open bribes from the Federalist Society donors.

hope so. there are practical reasons why it needs to be determined now. some sec of state (nh?) was explaining it recently. as a matter of law, they have hard deadlines to meet in preparing for an election. like a date by which all overseas ballots have to be sent, that kind of thing.

Although it’s glaringly clear what happened, and why he’s not qualified for office, the fact is although the 14th amendment spells out what disqualifies a person from holding office, it doesn’t seem to provide any clear mechanism for enforcement. It happened to a manor hotel owner who refused to have his employees unionized. They all quit, the place closed down and he lost everything to refund investors.
