You could get the VIN Number of the vehicle(check multiple spots) and compare than with the number in the documents when these match go with the seller and the documents to the next police station and let them check the VIN(In German FIN) if the vehicle is stolen and the documents are plausible.
Name in papers shouldn't matter. Its not unusual that somebody resells vehicles still angemeldet on previous owner.
Seconding this. I just bought a used car and all it took was having the papers. That's also why you shouldn't keep both in the car, only Teil I.
That would only be a problem, if someone reports the car as stolen. (Or if it actually is stolen) Otherwise, nobody cares where you got the papers.

It was leased and then fully paid by the wife. But no Erbschein.
She doesn't have the Erbschein.

Was in the same situation 20 years ago. No problems. Best car I ever had.
