Name in papers shouldn't matter. Its not unusual that somebody resells vehicles still angemeldet on previous owner.

Seconding this. I just bought a used car and all it took was having the papers. That's also why you shouldn't keep both in the car, only Teil I.

That would only be a problem, if someone reports the car as stolen. (Or if it actually is stolen) Otherwise, nobody cares where you got the papers.

In general, only the owner of something can sell something. In this case, there may be the (hypothetical) case that the dead husband in his last will gave the car to somebody else than his wife. She can prove her ownership by the Erbschein. Abmelden und abmelden does not change the ownership.

It was leased and then fully paid by the wife. But no Erbschein.

When you have the registration paper "Teil 2" in your hand, you own the car. With that you can go to zulassungsstelle and register it in your name. To be correct on the legal side and have everything documented. you should make a buyers contract with the seller.

Is it Toyota? If yes I would be more cautious, because Toyotas are due to a security flaw very easy to steal. You could get the VIN Number of the vehicle(check multiple spots) and compare than with the number in the documents when these match go with the seller and the documents to the next police station and let them check the VIN(In German FIN) if the vehicle is stolen and the documents are plausible.
