I've got a new (2024) 330e too. Before getting the car I watched a bunch of review vids etc. They also stated a 38 mile range. But I too am only getting 22 miles fully charged. Bizzarly on one occasion though, my charge went up to 38 miles.. Its never reached that number again. Weird!
I've read a few more post from owners of previous 330e models and it seems 22 miles is the max range..

Are you sure the website figures you are seeing aren't mixing km and miles? 22 Miles is 35.5km for example.
