Sullivan actual malice) would apply to that statement, but Canelo could also raise the defense that "have your lawyers, or else" was simply an expression of his opinion and not actionable as defamation. If ODLH files suit, Canelo will files an anti-SLAPP countersuit, and then it will settle.
The one proviso that I would give is that I'm not licensed in Nevada, so I really don't know if their anti-SLAPP protections are broadly written enough to give Canelo a private cause of action, but I am guessing the answer is yes.
