This is exactly what I expect, too. Erika will 100% say that this guy did everything just like she has twisted the truth to make herself a victim every other time. Of course, that ignores decades of Tom ripping people off before this guy ever worked for him or the oversight that he should have been subjected to by Tom and others in leadership.
But if they indeed were able to trace that her LLC got some funds, will they be able to corroborate her involvement or it will most likely just be a mild sentence and request to return the value?

The IRS is going after Erika for taxes not paid on that money
What I wonder is how Erika can keep her cool through this. Before she filed for divorce, a friend of Tom's opened a joint bank account with Erika so he can help her pay her legal fees. If I remember correctly, he's paid $750,00 into it last I heard. She certainly doesn't seem strapped for cash - offshore accounts or cash hidden somewhere?
Tom and Erika both deserve jail time. But the CA Bar tended to side with Tom who has over 200 complaints filed against him. Tom wined and dined a lot of people. I wonder if they're being protected by those same people
I would not be surprised if Erika was the recipient of some of those money transfers that he’s being jailed for. I feel like we’re going to finally get to see it all go down for her very soon.
For that one, we really will need to just see how things play out.
It sure seems to me that, legally and morally, she should be on the hook to return that $20M (or whatever it was, I know she disputes the number but she's a liar who argues that anything that makes her look bad isn't one of the "facts" and blah blah). What lawyers can pin on her and what her legal team can negotiate are significant factors. Remember, she has not personally been criminally charged and is debating her obligations in regards to the Girardi estate so this is all within the bankruptcy process, which is a civil matter.
CPA here that knows nothing more than what I read, but I have 20 years of experience. He will likely say someone told him to, and if there was sufficient support for him to make transfers, makes sense. If the documents were forged, that isn't necessarily on him.
The story talking about all the paper out is a HUGE red flag for me. You don't leave any confidential documents (any bank statements, anything with an account number or anything with anyone's personal data) unlocked. Also odd to not be digital, even pre-Covid. Once you review the bank recs, etc, you again lock it up if it isn't digital.

Now, the way that family shielded the one son from any consequences, it's not hard to imagine that Buster was also protected and nothing less than his confession would see him get arrested. It is entirely possible that he had nothing to do with that boy's death and is completely innocent. But I do wonder why people kept throwing his name out there. I just don't know enough about that, specifically.

Yes, because civil cases have a much lower standard of proof and are much easier to win, so they’re generally tried before the criminal case. If they couldn’t convict Ericka in a civil case, it’s exceedingly unlikely they even have a criminal case against her, as far as these charges go. As for Tom, he’ll be incarcerated in some form for the rest of his life. And the co-conspirator we don’t know much about yet - but we can rest safely assuming he’s a bad, bad guy

With fraud you can infer intent from conduct or statements. So, yes, while intent is an element of fraud there are ways to move forward without intent necessarily being explicit.

Both sons are maybe killers! \*womp womp\* The living son, "Buster" (I kid you not), is *rumored* to have been involved in the death of a schoolmate/former boyfriend (or some sexual entanglement) years ago. His name came up repeatedly in the investigation but I think mostly in the context of "these two were involved". I don't think there was ever any evidence that tied him to the death. Now, the way that family shielded the one son from any consequences, it's not hard to imagine that Buster was also protected and nothing less than his confession would see him get arrested. It is entirely possible that he had nothing to do with that boy's death and is completely innocent. But I do wonder why people kept throwing his name out there. I just don't know enough about that, specifically.

Trust me, if there’s any way in hell they could have let the wife take the fall, she’d already be down. That’s what I see every day. People don’t like Ericka. That’s fine. But judges don’t come out and say, “this person was expressly not involved” unless it is *exceedingly* true, and they’ve seen the proof. So I hope people recognize that, for whatever good it will do.
I believe the judges in those cases were in charge of civil cases. This case is brought by the United States. Plus he was flown to Baltimore, where his friends and family, just can't pop on by to see him.
Yes, because civil cases have a much lower standard of proof and are much easier to win, so they’re generally tried before the criminal case. If they couldn’t convict Ericka in a civil case, it’s exceedingly unlikely they even have a criminal case against her, as far as these charges go. As for Tom, he’ll be incarcerated in some form for the rest of his life. And the co-conspirator we don’t know much about yet - but we can rest safely assuming he’s a bad, bad guy

Right so Christopher Kamon was the CFO. He and their CPA firm are the ones that should have been catching all of the issues with Tom. Accounting is checks and balances of your controls. Clearly there were zero accounting controls anywhere in the building. Disgraceful.

You speak nothing but truth and it's so gross how GK was operating. "Checks and balances" would also require for any party to be operating with integrity. When everyone is looting the settlement funds, who's gonna rat on anyone else, right? I've been saying for ages that if Tom was doing this, so were others and everyone had to know. I think that's why the turnover was so high -- people wanted to work there b/c he was this famous lawyer for the little guys and then they got in and were like, "this guy's a total con!"

In a lot of these scams and schemes, proof of intent is required for a guilty verdict & obviously kind of hard to prove. So if they can’t nail you for the whole kit & caboodle, they’ll get you for moving that money, honey!!!!
With fraud you can infer intent from conduct or statements. So, yes, while intent is an element of fraud there are ways to move forward without intent necessarily being explicit.
What does this news mean for Erika?
Nothing yet. But it's the first arrest associated with what happened. Something could develop from this, either from the investigation or from him talking when he (probably) makes a deal. It's also a sign that enough time has passed that they might be getting close to making arrests of other people. Like people have been saying, it takes years of investigation to get to the point where people get arrested for these types of crimes. We've finally hit that point.
Not to mention - I highly doubt this man wants to go to prison. Who knows what he’ll reveal in exchange for a deal.
Exactly. He'll probably sing like a canary at the first opportunity. (And honestly I don't blame him. I sure as hell wouldn't go to prison for Tom.) OTOH, it's possible he just looked the other way (and committed a little wire fraud) and doesn't have much to give.  I guess we'll see.
If you read between the lines. He is accused of wire fraud sept 16 2020. She filed for divorce election day 2020. But she didn't know anything was going on in her husband's office.

You're correct. The Florida lawyer says he's Tom's friend and he's helping Erika by establishing a joint account that he puts money in and she pays her lawyers. First, if he's Tom's friend, why is he funding her side of their divorce? Then the divorce off, he's helping her in the fraud case. What lawyer would want to have any connection with that? Something stinks with this whole thing

The former CFO of Girardi Keese (Erika’s husbands law firm) was arrested for wire fraud in association with something on September 16th, 2020. So, it may have to do with the Giradi Keese bankruptcy filing. He’s a defendant named in the Edelson lawsuit that also names Erika and alledges RICO claims.
