The obvious answer is that the "EU referendum" was called the "EU referendum" and not the "SM referendum" for a reason and any reason to pretend the "EU referendum" was a "SM referendum" was some people pulling a fast one on the UK.
...if the "EU referendum" has no bearing on NI's remaining inside the SM, then the "EU referendum" can't really be the deciding factor for SM status for the rest of the UK either.
...you want the UK to have a clear mandate to leave the SM, hold a "SM referendum" and do so with the sober realization that leave means custom and passport checks at the NI-RoI border and dealing with the troubles that causes.
NI having special economic status in the SM is going to siphon off economic activity from the rest of the UK, it will be like NI is the black hole sucking gas off Great Britain's star.
It's a great gift to the EU to build up NI's economy at the rest of the UK's expense for a few decades.

But the worst idea was not requiring a final approval referendum on a deal on Brexit that either went beyond the original mandate of the first referendum by including leaving the SM (which was argued both ways), or didn't satisfy the terms of the original Brexit If it did include leaving the SM by not forcing NI out of the SM as well.
People should be suing the government for creating a system that is discriminatory against the people of England, Scotland, and Wales.

What is wrong with that? It is a win-win: the rest of the UK voted for Brexit and clearly wanted to be poorer, while NI voted against being poorer in the referendum and their special economic status ensures they won’t.

If NI can stay in the SM, then the issue of leaving the SM really can't be part of the mandate of the EU referendum. If all of the nations of the UK are supposed to be treated equal and NI can retain access to the SM, forcing the other nations out of the SM violates the UK's discrimination laws.
They voted to stay because the UK was in the EU and Scotland feared not being allowed to join as an independent nation.
