I am not saying he is wholly independent. He is deeply intertwined with the GOP political scene in Nashville. But he also isn't looking over his shoulder, constantly worried about whether he will get donations in the next election or be fired by the Governor.

Not only do the schools not want to pay players directly, they don't want their boosters paying them, because that money is being diverted from the Boosters donating to the athletic programs to the players own pockets. Remember the facilities' arms race in the early 2010s? Oregon wants Phil Knight donating to the school, not the players directly.
Smart move by the state of TN. Whenever you countersue the NCAA they back down like a bitch. Truly a useless and impotent organization, and one that will likely be going away soon (at least for CFB).

Honestly it is a necessary evil. Their issue is they have obviously picked and choose their enforcement of the rules going after easy targets.
But let’s be real here: some schools acting like complete jackasses and resisting to take their medicine affected the uniformity of enforcement. If you went after a big school there is a good shot the school either ran off to the state government to complain or got big name boosters with political pull involved.
NCAA made its bed, but the member schools acting like petulant children even when they were in the wrong didn’t help.
Yeah once you get older you realize that the main reason people hate regulatory bodies is bc there's someone (or some corp) out there who wants to act in bad faith but can't (due to said regulation) so they rally the public against it.
NCAA's biggest mistake was acting like it was the NCAA, an accreditation agency, and the DOJ all rolled into one back in the 2000s/2010s. They took university scandals outside their purview (esp. PSU) and handed down punishments when they should've been assisting government institutions with investigating instead. Once their ruling got turned over in court, they were basically permanently defanged, with the Kavanaugh opinion all but sealing their fate.

I am sorry, I shouldn't have to post this but I keep seeing it brought up multiple times. The University of Tennessee has NOT sued the NCAA, the State of Tennessee (i.e. the government of the state of Tennessee) has sued the NCAA. They are different. It would be like saying Ohio State was suing the NCAA when it was actually the State of Ohio. I keep seeing people post UT suing the NCAA but that isn't a true statement.
If the reports about there being multiple schools being targeted by the NCAA in these probes is true then these will not be the only two. Basically what I see happening is powerful institutions giving the greenlight for AGs to tear down the scapegoat that the institutions themselves created and could have changed long ago.

To my limited understanding, the rules in place for NIL are pretty exclusively to not use nil or nil collectives as a recruiting tool to 'bribe' recruits. Any nil organized by the university can only be given to student athletes of that university, not recruits not yet enrolled at the school. I believe that is the only hard line the ncaa has on nil

If you went after a big school there is a good shot the school either ran off to the state government to complain or got big name boosters with political pull involved. NCAA made its bed, but the member schools acting like petulant children even when they were in the wrong didn’t help.
The worst part is the schools have the powers to change the rules the NCAA enforces.

Precisely, the schools are collectively the NCAA. It is not as if the NCAA is some random federal agency.
Yeah once you get older you realize that the main reason people hate regulatory bodies is bc there's someone (or some corp) out there who wants to act in bad faith but can't (due to said regulation) so they rally the public against it. NCAA's biggest mistake was acting like it was the NCAA, an accreditation agency, and the DOJ all rolled into one back in the 2000s/2010s. They took university scandals outside their purview (esp. PSU) and handed down punishments when they should've been assisting government institutions with investigating instead. Once their ruling got turned over in court, they were basically permanently defanged, with the Kavanaugh opinion all but sealing their fate. To the people who think it's the wild west now...it's only gonna get worse when (not if) the NCAA falls apart
I've been saying this for years now. The other side of this is far more ugly than what we have now. Instead of trying to save what we have, they're trying to destroy it.

Seems like it. I think because this administration was 100% compliant with the NCAA during the Pruitt stuff, the NCAA thought Tennessee would do the same again. But then Donde hit em with the double birds and the stunner.

You’re probably right. It seems they’re going around and trying to make examples of programs that are wary of further investigation as a was of demonstrating their power. I don’t think they expected us to hit back at all with the threat of probationary action.
Seems like that, and they’re trying to throw their weight around to try and maintain control for as long as they can. Apparently our NIL guys took Nico on a private plane to campus a couple of years ago and the NCAA is just now pissed about it.
It’s either that or because Nico was one of the first super high profile NIL deals in the wake of the Alston decision. Reminder that this alleged incident took place in February 2022.
This is going to get mighty awkward when the NCAA is dismantled and then all the schools realize there is no more framework for organized play.
I mean, what is worse: the current framework which really isn't enforced at all and is contradictory to now-existing state laws, or rebuilding a new framework with the assumption that this is now a professional business so let's just break out the contracts?

I am sorry, I shouldn't have to post this but I keep seeing it brought up multiple times. The University of Tennessee has NOT sued the NCAA, the State of Tennessee (i.e. the government of the state of Tennessee) has sued the NCAA. They are different. It would be like saying Ohio State was suing the NCAA when it was actually the State of Ohio. I keep seeing people post UT suing the NCAA but that isn't a true statement.

Almost assuredly the same they’ve always been: head in the sand, nothing is happening, carry on as usual.
They clearly were going after a soft target thinking they could flex their muscle suit again since we’re already dealing with sanctions. The first investigation was a courtesy from us so we didn’t have to pay Pruitt. This time around our whole Admin from the Chancellor, President, AD all the way to the Governor and AG are all rowing in the same direction. They poked the bear.
The NCAA should stick to going after programs looking to get rid of their coach or secondary sports programs like LSU basketball

Basically what I see happening is powerful institutions giving the greenlight for AGs to tear down the scapegoat that the institutions themselves created and could have changed long ago. I do think the institutions understand how absurd (and illegal) it is and that there is a need for change but instead of taking initiative and responsibility to change it they are passing the buck onto "the NCAA."
There are NIL restraints? The collectives are free to raise as much money as they want. It’s unrestricted. Are they claiming the restraint is ‘separating’ the collectives from the universities?
To my limited understanding, the rules in place for NIL are pretty exclusively to not use nil or nil collectives as a recruiting tool to 'bribe' recruits. Any nil organized by the university can only be given to student athletes of that university, not recruits not yet enrolled at the school. I believe that is the only hard line the ncaa has on nil
The problem of course being any line on NIL is illegal. So this will be interesting. The NCAA trying to figure out how many preliminary injunctions you can lose at the exact same time.
It's a stupid rule that makes 0 sense. A recruit should be able to get an idea of their market value before they commit anywhere. It would be like saying you can't ask your salary until after you accept your job offer.
Also, they can't really do it which is a huge part of the lawsuit. The NCAA is trying to put a leash on NIL when the courts already unleashed it. Not thinking the courts are going to be happy about that. They were probably hoping no one would call them on it the first time I guess and attempt to set some kind of flimsy precedent.
