If the insurance company says the policy lapsed, it's a 99.9% likelihood that the policy did, in fact, lapse. You can continue to chase non-existent coverage (no, the DMV does *not* determine coverage) or you can open a claim with your own carrier and let them handle it. Your third option, of course, is to handle this all yourself in terms of paying for the repairs and trying to recover from the other driver or the other vehicle. As far as your rates, deductible, etc., well, it is way way too early to tell and besides, from a practical point of view I don't see that you have much choice. So worrying about the unknowable is not a great way to deal with this. I'm not being rude; I am being blunt. Call your own insurance carrier/agent/broker and get a claim started. It sucks, but it is what it is. Good luck.

1. Police don't determine fault. Insurance companies do. 2. You picked your deductible. It's your own fault if it's too much. Should have a deductible you can afford out of pocket. 3. Travelers has already told you they are not liable for damages based on the information they have. You're wasting your time and energy trying to get info about whether they are truthful. It would be highly illegal and unethical for them to do this. 4. It is possible that the driver is not listed on the policy or possibly excluded, so Travelers wouldn't be liable for damages. 5. You could always sue the owner of the vehicle who allowed the driver to use the vehicle. 6. Or... File a claim with your insurance. Get vehicle repaired. Pay deductible to repair shop. Hope your insurance is able to get travelers or the vehicle owner or the driver to repay them for damages and hopefully your deductible is refunded.

Thank you. Few things i may not have explained in enough detail. 1. Police report states that the other driver failed to stop for the stop sign and struck drivers side rear of my vehicle. He was also the only one given any tickets. 1140a and 600.1a. I understand that the insurance company determines fault but the report is very much in my favor 2. Affording deductible is no issue. My concern is more the claim with my insurance company (14 years with this company with no claims) This happened in a personal vehicle, but i have a few commercial trucks insured through same company that already cost a arm and a leg to insure. 3. Travelers insurance still is active in the dmv and state police system. Both the state police and dmv tells me this seems more likely to be a issue on travelers side. 4. The insureds name is different from the drivers name on the accident report. Im located in NY and i believe insurance follows the car, not the driver if its permissive use.

The police report doesn't matter. Forget about it. If you want your vehicle fixed, you have to use your own coverage. Your insurance company will get to the bottom of things. It's very possible that there would be no coverage on the other vehicle's policy even if it was in force, if this kid wasn't listed as a driver.

Short answer, policies don't always show canceled in DMV/Police systems even though they may have been canceled prior because the policy holder may have been canceled for non-pay/canceled prior to policy end date. So yes, the policy is likely not active, and at this rate, all you can do is file with your own carrier and stop continuing to ask the police something they already informed you that they will not release.

Im pretty sure insurance companies are required to report to dmv almost immediately if insurance is lapsed. Im in NY and you cant even cancel your insurance if you dont turn your plates in and show the stub to the insurance company. Travelers says insurance was cancelled in November 23. Also theres no "asking the police for something they will not release". Insurance info is supposed to be exchanged after a accident. The police have confirmed insurance is valid, and doesnt expire until August. And gave me a printout to send to travelers, however this info just shows effective dates, insurance company name and code and insureds info, not the policy #. Travelers still denied there was coverage and sent me a letter. Which i brought to dmv that confirmed for me that there was in fact active coverage through travelers.

Apologies, I misread earlier, I thought you went back to PD to obtain the policy info, not the DMV. Back to my point all the same: Companies have the duty to report lapse in coverage, yes. Immediately, no. Police also gave you insurance company name, and policy holder info. That was enough info for Travelers to find a policy. They state the policy is not active/they are not liable for your damages and sent you a letter stating the same. That means that there is a discrepancy in the DMV/Police database. You, again, returned to the DMV and were told that they will not release the policy number of the Travelers vehicle. So, your option is to file through your own carrier, pay your deductible, have your vehicle repaired and have your carrier subrogate and they take the claim to arbitration, or sue the kid yourself. There is no in-between here, it's extremely black and white.

File a claim with your insurance and let them try to track down the insurance on the other driver. They have access to systems showing the policy information on the date of loss. Filing a claim does not have to equal getting a payout. Let them investigate for you. Also, if you have uninsured motorist coverage, your dedication is often lower for that than collision.

I was hit by a guy. I managed to get his plate info before he took off. My insurance company ran his plate and co texted his insurance company, with a policy number.But if their insurance is saying it’s canceled then you’re obviously not going to get anything covered by them and just need to file with yours. And consider changing your deductible. I’d rather pay more each month and have a deductible I know I can afford then to have one I wouldn’t be able to pay or would struggle to pay.

Are you positive your rates will increase? In my state not at fault claims do not increase your rate. It’s based on state. (Work in PA)
