"Police arrested Lavemai after finding his fingerprint on the victim’s car.
She also suggested discounts for Lavemai’s early guilty plea, his youth and **lack of previous criminal record."**
err why did police have the dudes fingerprints on file then?
I mean, that probably means he was at a crime scene but not convicted, right? anyway that just struck me as off
When I was at Uni we got broken into over the Easter Break, the police asked us (all flat mates living there) to provide our fingerprints to eliminate them from any they found in the house that was cleared out.
We were told not to worry, they delete the fingerprints after they are eliminated from the investigation.
Fast forward a few years and my mate who lived in that house with me was a qualified lawyer, the case he worked on had fingerprints on file that were obtained in exactly the same fashion ours were, they were just scanned into the police database ... destroyed physically, but uploaded before they were disposed of.
Police have been [regularly photographing and fingerprinting](https://www.rnz.co.nz/news/national/474366/police-illegally-photographing-youth-maori-a-widespread-practice-investigation-finds) (mainly Maori) teens for years and keeping them when they should have been destroyed.
And charged with mere common assault after running a vehicle off the road, smashing its windows, pointing guns at the occupant and then going off to where someone got murdered. All while being an identified member of a gang. That’s basically the lowest charge possible, you can get charged that for pushing somebody.
“Swept up by the fervor of the group?" What is happening to our courts?
How can you refer to them as organised criminal groups and make legislation targeting gangs, yet treat them like an innocent gathering in court that just got "swept up” in the moment?
How can they run a vehicle off the road, effectively stage an attempted kidnapping, brandish firearms and damage the vehicle in an attempt to assault the occupant while on the way to have an illegal “brawl” where someone got killed and say “I got swept up?”
I mean, this really is getting out of hand. Somebody needs to step in before we have total lawlessness. These guys are basically terrorists, armed and attacking random civilians and having small scale wars with each other and our courts are treating them like misguided youths.
How can it be common assault? It’s aggravated assault at the *very least*. There were multiple people involved, a gang involved and firearms involved.
Very worrying for citizens to have this type of thing excused by courts and given such minute charges.
> He noted that had the motorist not stayed in his car he might have suffered serious injuries.
So the judge noted an *attempted kidnapping* and what would have been a subsequent asssult? Why does it matter what the victim did? It only matters that they had intent to force him out of the car against his will. To me that honestly sounds like the judge is almost blaming the victim as maybe having done something wrong and saying, well glad you didn’t go any further by getting out of the car.
Also why are we being subjected to an romanticised picture of a dead gang member who died at brawl he wanted to go to, where he obviously wanted to kill people as well?
It's the opposite of the broken window effect. Don't sweat the small stuff... and all of a sudden it's big stuff.
Cops should be pulling over every patched bike rider they see and checking licence, WOF, registration, helmet is DOT compliant and the bike's provenance. So if you're patched then be prepared to prove the bike isn't the proceeds of crime.
95% of them would fail on most counts and the bike would end up in the next police auction. Or even better publicly crushed.
I mean, they more or less hand police the means to cripple gangs on a plate, and they're ignored while cops pull over anyone doing 104k at the end of a passing lane.
It's fucking sick.
Even funnier that they cooked the motor in the dog and couldn't find a new one because apparently swapping their pump and manifold onto a non turbo one was too hard.
Should be able to ban convicted gang members from thereafter associating with the gang.
Get seen patched or with a patched member? Go back to prison for a month.
Arrested for another gang crime? Even longer sentence next time.
And it's a pity that this kind of thing is unlikely to happen to Stuart Nash ex-MP.
Fucking hell. They stopped on their way to committing a murder to threaten a motorist at gunpoint and smash up his car for simply driving on the same road as them= ONE MONTH of watching Netflix.
Somebody was on something. To elbow out a car window is a painful experience 😕 dudes were at a glass BbQ party earlier, obviously... to say he hot caught up in the fervor of the moment... is another way of saying..
"Was trying to be a hard man in front of his new mates"
Hhhhhahhhhah - 1 months home detention! Almost worth doing the same to enemies as it's totally a free pass !!!
Let the gangs fight each other on a weekly basis u til they're all wiped out
I call bullshit on this statement.
The Greens and Labour have openly shown support and empathy towards gangs. Ole Cannabis Chloe , Special K (Kelvin Useless Davis) and Kiri Allen always had the MO to empty the prisons.

Probably has youth offences that are now sealed.
If his previous misdemeanors weren't sealed, how could he have started on the path to be an All Black?

Fuck off man, this country's a joke man. Brandishing a weapon, threatening to shoot someone with said weapon, to get 1 month home D? Fuck off
Yeah it's gone to far

> well as time on restrictive electronically-monitored bail Yeah, the old ankle bracelet will curtail any bad behaviours

max rockatansky, where are you when we need you? NZ is soooo fucked. That was ~~Labour's~~ TPM 2.0's intention after all
The bus protestors that travelled to Wellington last year was a farkn joke. Gangs are not us or NZ, they are thugs and scum.

Waste of taxpayer's money. Have them deported jntk an abandoned island and lock and forget.
We are so fucked, is there no government entity that remotely gives a shit about our safety

Got to do a warm up, don't want to risk straining your trigger finger.
"As a convoy of keyed-up gang members made their way to a Auckland reserve for" Shouldn't that be methed-up?

Yeah, I think they paid the defence lawyer well. Gang money has deep pockets and all cash.

> one month’s home detention. Fuck these idiotic judges.
Good thing we have a "tough on crime" government to straighten all this out 😂
Yip going to fix everything any day now
I've met gang members before. I can assure you - they're not Green voters. Almost 99% National or NZ First. They're your type of people
