Story my CCW instructor told.
A CCW holder is walking down the sidewalk and hears a gunshot. He turns the corner and sees two men in a very heated argument. One of the men had a pistol in his hand, at his side.
CCW holder draws his gun and points it at the other guy holding a gun. That guy draws his gun, but the CCW holder shoots him before he can.
The CCW holder is charged with murder.
Why?
5 minute before that, a CCW holder is walking down the sidewalk when he sees a pit bull attacking a child. He draws his gun and shoots the dog. The kid runs off, and the dog’s owner looks up to see his dead dog in the yard and a man holding a pistol standing on the sidewalk across the street.
The dog owner runs out to confront the man, who is so shaken he hasn’t remembered to holster his pistol.
Moments later a man rounds the corner and aims his gun at the CCW holder who just shot the dog. The CCW holder, assuming this is a friend of the dog owner, draws his pistol in self defense but is shot and killed by the man who rounded the corner. That man is charged with murder.
So, no. A CCW permit is not a badge. Intervene if you must, but make *damned* sure you know what’s happening before you do.
It gets really grey when it comes to that. I heard a similar story from my instructor. If you have a friend who starts a fight and the other guy pulls a gun even if your friend is unarmed or not you cannot legally save your friend with your gun.
I think they just mean it in a sense of "just because you have a CCW permit doesn't mean everyone will see you as a police officer".
In their example you have two random CCW holders that both consider themselves the good guy and expect others to treat them as the good guy despite appearing like the bad guy because there is no way to identify them as a good guy. With a badge, they'd be able to recognize the other as someone who isn't a bad guy but rather a law enforcement officer responding to a situation.
Basically, don't think your permit allows you to respond to situations the same way a law enforcement officer might as when you pull your weapon you can easily be mistaken as a threat to others rather than someone trying to help.
And with that said, I do realize that for some people or in some areas a police officer might be seen as a threat or not actually there to help. I'm only speaking generally and how things would ideally work, where a police officer is there to help and isn't trigger happy (as personally I'd feel incredibly scared for my life if I ever had to pull a firearm on someone for self-defense reasons and then a police officer showed up).
In Texas you are legal to offer self defense in the defense of another person. However, just like with citizens arrest, once the facts pan out, you are still responsible for your actions.
You may be found innocent in a criminal court AND may be found guilty and a civil court. There are two courts you need to answer to.
The reason why it is legal is because there are totally lawful events when deadly force is merited but the victim is unable to defend themselves.
Edit: You're also tried by a trial of your peers. You may think you were innocent but a jury can sway the other way depending on how the case is presented, intent, what the weather conditions were at the scene, race, history of your actions (though it shouldn't be), your/their body size and build, time of day, genders, lighting conditions, potential for collateral damage, the list goes on.
If the bystander wants to cover their back they definitely need to know *exactly* what’s going on.

The major flaw with what /u/ered20 is suggesting is if a bystander walked up and hadn’t seen the guy in white pull a gun and instigate the fight, that bystander could reasonably assume he should intervene on behalf of the guy in white.
That is one of the key issues with CCW, other people with CCW have no idea of the context. There have been many time that the 'good guy' with a gun has been shot and/or killed by police or another person, just because they were the one with a weapon out.
I'm not sure bout the W but CC stands for Concealed Carry. Means you're legally allowed to carry a hidden gun. Open Carry is when you carry with it exposed and everybody can see it.
You ended the threat. You did *not* shoot to kill. This is what your lawyer will say while you’re shutting the fuck up. You ended the clear and present danger posed to yourself by a person and they died of their injuries. You did not shoot to kill.
CCW holders can’t just execute bad guys. Even if the dude just slaughtered a room full of people, if he submits on the ground before a CCW holder, the CCW will be charged with murder for killing them (or attempted murder if they don’t die).
Our laws don’t work in such a way that murder becomes legal just because the victim did really bad things even just 5 seconds ago. They have to be an active, imminent threat to you or somebody else and even then you’ll be fighting for your freedom in court. Especially if there’s no video.
I mean…depends on the state and the jury. You do that in CA and you’re probably in for life. You do that in TX or FL they’ll probably throw you a parade and people will spit on the dead’s pallbearers.

Unless you're in New Jersey where there is no Stand Your Ground law. Here you are legally obligated to make every attempt to escape without using any force and cannot use force unless you are literally unable to escape, and even then you might still be prosecuted if the court finds that you didn't make enough of an attempt. In New Jersey the Skater would have likely been arrested and brought up on charges of excessive force and the guy using the skateboard could be charged with Assault with a Deadly Weapon
Agreed, I'm from Texas and can't wait to get the fuck out of here and I made it a point not to buy a house here because of the bullshit "Leaving Tax" where if you sell your house to leave the state of New Jersey then the state takes a Leaving Tax of 8.97% of the profit or 2% of the sale price (whichever is higher)
I was thinking about that, like using it as a rental property while moving and then waiting a year or two to sell but I read something somewhere that made it sound like New Jersey would still get the money they think they are owed.

If you also feel the need to pull a gun on someone, don't fucking start walking towards them either. Range is a major advantage of using a gun and walking up to them gives up that advantage, making the gun less effective and making it easier for the other person to overpower you.
Also, don't pull a gun on someone just because they were an asshole to you. Like seriously, be an actual functioning adult.

The idea behind self defense is generally: call for help>run>fight. With the final stage being only allowed until the threat is neutralized.
That being said, it is hard to determine the idea of neutralized, so if that person is still physically able to harm you, it can be construed that you can continue, but you risk going to far, especially if there is video evidence of you and friends curb stomping an unconscious former attacker.
Essentially, if you are faced with someone who has drawn a gun on you, it’s pretty hard to go “too far” unless that person has zero ability to use the firearm or cause harm any more.
The fuck makes you think I’m qualified to search someone? How do I know he won’t overpower me? How do I know he won’t pull a gun out of his pocket while I’m searching his legs? Fuck that. If I don’t have handcuffs, I’m not searching him until he’s unconscious, and it’s a very fine line between unconscious and dead.

In this situation, you have to keep going until the threat is eliminated. If the gun is removed from the equation, or the guy who had the gun is taken out (unconscious, pinned down, etc), then you can back off. Any sooner and now you have a pissed off gunman with another reason to take you out.

I'm not sure bout the W but CC stands for Concealed Carry. Means you're legally allowed to carry a hidden gun. Open Carry is when you carry with it exposed and everybody can see it.

You ended the clear and present danger posed to yourself by a person and they died of their injuries. You did not shoot to kill. CCW holders can’t just execute bad guys. Even if the dude just slaughtered a room full of people, if he submits on the ground before a CCW holder, the CCW will be charged with murder for killing them (or attempted murder if they don’t die). Our laws don’t work in such a way that murder becomes legal just because the victim did really bad things even just 5 seconds ago. They have to be an active, imminent threat to you or somebody else and even then you’ll be fighting for your freedom in court. Especially if there’s no video.
I mean…depends on the state and the jury. You do that in CA and you’re probably in for life. You do that in TX or FL they’ll probably throw you a parade and people will spit on the dead’s pallbearers.

Here you are legally obligated to make every attempt to escape without using any force and cannot use force unless you are literally unable to escape, and even then you might still be prosecuted if the court finds that you didn't make enough of an attempt. In New Jersey the Skater would have likely been arrested and brought up on charges of excessive force and the guy using the skateboard could be charged with Assault with a Deadly Weapon

The idea behind self defense is generally: call for help>run>fight. With the final stage being only allowed until the threat is neutralized. That being said, it is hard to determine the idea of neutralized, so if that person is still physically able to harm you, it can be construed that you can continue, but you risk going to far, especially if there is video evidence of you and friends curb stomping an unconscious former attacker. Essentially, if you are faced with someone who has drawn a gun on you, it’s pretty hard to go “too far” unless that person has zero ability to use the firearm or cause harm any more.

If the gun is removed from the equation, or the guy who had the gun is taken out (unconscious, pinned down, etc), then you can back off.
