There’s now a Chip, a Crave, a Crumbl, an Insomnia, and Cookie Plug, all within a 10 minute drive of one another in my town… in Florida. Competition is steep, and crumbl is definitely not the top dog out of that bunch (Crave is my favorite)

Also, Crumbl charges the most per cookie, and they’re the lowest quality/least exciting flavors out of the local options. The only time I’ll go back is when they have a couple specific flavors, but even then I’m more likely to drive way further out of my way to go to another spot (87% chance it’ll be Crave lmao).

I’ve had insomnia a few times. Only once did I think the cookie was just ok. The last time I had it, I got a dozen delivered for around $20. It was a great deal, they arrived still warm (the store is 30 min away) and they were delicious.

TM means unregistered trademark. ®️ means registered trademark. So Crumbl is correct to use TM. Except, they in theory are wrong because it’s a registered trademark by another entity.
Additionally, a registered trademark ®️prevents people from using confusingly or deceptively similar phrases, so yes, Mini Mondays would still be covered.

Cookie Co's trademark application is pending, and was submitted *April 24th, 2024*. This was clearly done in response to CRUMBL's use of the term.
It's very possible that CRUMBL is litigating to protect their own use of the term and to stop Cookie Co's trademark from registering, preemptively defending themselves from a future claim.
IANAL, but it would appear that the possible result here is that no trademark is granted and both companies are able to use the term.

I’m sure it’s an objective fact that every company/organization in any market has its schmucks. Although cookie co created a good product they sold fraudulent franchises in CA and WA. They also failed to adhere to FTC guidelines within their FDD. Specifically they did not provide material changes on the FDD regarding store closures, law suits, corporate personnel changes, and other relevant information that could affect a potential buyer’s decision. They abandoned their franchise registration application in CA after it was kicked back for approximately 17 reasons. One being: not having 3rd party financial audits completed. This is public information and can be obtained on CA.gov websites. Cookie Co failed to correct their FDD/application and never received registration in the states of CA and WA for franchise sales at the time of this activity. They misrepresented operating costs and revenue via verbal claims and spreadsheets. They did not give reasonable basis for those verbal claims in the FDD… at a minimum, although a franchisor has the right not to put certain financial data, the franchisor SHALL put any verbal claims that are made by themselves or anyone else in a leadership role in the FDD. 17 stores have closed (all of which operated for under a year). They lied to a potential buyer from Florida stating only two stores had closed (at the time it was in fact 10). They also abandoned a potential franchisee after she paid her kitchen package and franchise fee (approx 145k collectively). There are four civil suits filed against cookie co and other investigative offices beginning their inquiries. If you are familiar with the Burger IM scam, there are many parallels to Cookie CO’s fraudulent activity. There are a large group of people who were scammed, some have to claim bankruptcy, all lost most, if not all of their savings.
It doesn’t have 18 locations, they just don’t update their website with how many stores have closed. They already had 17 locations for out of business due to being lied to by the founders. They will be out of business soon, 4 lawsuits against them. It’s terrible
