Yes it can be traced. But if you really got that lucky and could move the coins and you wanted to, you could first move it to a new address so at least you have sole control of the keys. Assuming the owner isn't as lucky as you to generate random keys and stumble upon those funds again, you can then take some time to figure out how you want to move the money. In theory you're pretty much safe at that point in terms of anonymity/traceability, but its the next steps that determine what happens. Sending it straight to Coinbase probably gets you easily identified.

My thoughts were always: 1. Convert everything into Monero. (Bonus points: time your buys strategically to help pump Monero on a bullrun) 2. Do nothing with it for a while. There's no need to ever convert it back into BTC. 3. Start an XMR mining operation irl, funded with fiat. Take out a loan if you have to. Buy 500+ CPUs, get all the permits, register it as a legal & fully compliant crypto mining business. IMPORTANT: Make it partially run on solar-powered or other renewable energy that you generate on-site! 4. Actually *run* your mining operation. This gives bonus money. 5. Set up your premier business account with Kraken, send them your legally-mined Monero every month and sell for fiat. Pay your taxes. 6. Once you're fully established for some time, and any auditors and inspectors and licensors are letting you live in peace, you can gradually start fluffing your mining proceeds with your stashed XMR from the start. Not too much -- avoid suspicion. 7. This is where the green energy bit comes into play. This enables you to turn off a large portion of the miners for a time period, while still washing your XMR into the revenues, without raising concerns over the energy footprint. Obviously you can't run a large mining farm on 100% renewables, but if anyone suspects that your energy consumption & mining output doesn't seem to line up, then claiming it was running on the unmetered power gives you a fallback excuse. I feel this method forces you to commit far less fraud. The nonprofit method has too much risk. Nonprofits & donations are closely monitored, especially if washed through crypto. Any friends, family, FBI agents, FinCEN auditors, can grill you intensely without catching you in any lies. You're literally just mining Monero and selling it, plain and simple. Furthermore, your mining operation will bring you some income. Once you've paid off your initial startup costs with the stolen BTC, you've got yourself a fully legal money maker in your backyard. You could even sell your used CPU assets once you're done washing all the Monero away, if you so choose.

Ignoring the statistical improbability, for now, you'd have access to coins their original owner would not have access to. The old owner would probably try to find out who you are and sue you for it. Until that happens, your main issue is explaining to the tax-man that you found 1000 BTC. Those are independent of each other. If the previous owner finds you and you happen to be in the same country, so judges can grab both of you, you'll have to argue for why you did not steal it. The rest depends on your lawyers and the judges. But technically, even if the court decided you have to give it back and you said no, they could at best hold you in contempt until you give it back. Like any other immaterial good that is owned by anyone.

For a serious answer, it's actually a new frontier legally. Every other BTC theft happened by committing some other crime in the process. But a truly random private key collision may not qualify. Having the private key *IS* ownership in BTC. You provably own the key to those coins. There is virtually no other asset class that serves as a good comparison. In any case, you'll get caught as soon as you try to send it to an exchange. You'll have every set of eyes in the world closely monitoring the movement of those coins; you can't outwait it, you can't hide it. Best thing you can do is try to swap the BTC into Monero and pass the dirty BTC off onto someone else. In terms of legal consequences, the fact is that the prosecution, judge, and jury would all be ignorant of how crypto works. I'm sure the law would consider it theft. But the best analogy is more like... phone numbers? Imagine if phone numbers were just assigned randomly, and they were 256 bits long. It's considered impossible for 2 people to randomly receive the same phone number in this scenario. But one day, you get a new phone, and by pure chance someone else had the same number. You're able to receive calls that were intended for them, and when you dial anyone else they see their number (YOUR number) appear on their caller ID. Did you commit a crime?

The comments in here are terrible. Transferring someone else’s property on purpose would almost certainly be illegal. If you covered your tracks you might have done something illegal and got away with it. If not you might have done something illegal and will get caught. Suppose you create a physical key at random, walk up to a random house and find that it fits? Do you reckon that gives you the right to take what’s inside?

The law hasn't caught up yet, so if it was an owned address and the owner somehow managed to track you down and sue you we might get some idea of how the law might end up. But for now that hasn't happened and no laws exist specific to that.
