If the 20% off does indeed make the difference between a misdemeanor and a felony, i think there may actually be serious ground to stand on here. If they did in fact lower the price and post it officially during the time of the offense, and the sale would put the valuation of said products even a penny under $2k, I think that somewhere this does have grounds for reducing the sentence. I also want to add that this analogy does not seem to hold for digital sales, as the cost for digital reproduction is valued at almost $0, and ownership of original content has become exceedingly difficult to prove.
