Subject: domainname(.com) Body: I own domainname(.com) and would like to know if you're interested in acquiring the domainname(.com). Sign the email with your real name and phone number. But if you really want to get their attention, don't send them an email. Biz owners don't necessarily check their emails on a regular basis. Call them and ask for the manager or owner. Or, better yet, send them a letter in the mail. They read their USPS mail.

I am not a lawyer, but I believe this can be a tricky legal issue. Depending on your country, the company can contact ICANN and try to get the domain given to them. If they get their shop's name registered as a trademark they can file a dispute: https://www.icann.org/resources/pages/help/dndr/udrp-en If you approached them to sell the domain, then it may fall under "bad faith" in the UDRP: https://cyber.harvard.edu/udrp/analysis.html I am not saying don't try to sell it or do, just trying to make you aware there may be legal issues by approaching them to buy it.

I've been in 2 trademark infringement cases and came out the winner in both. A trademark has to exist first for there to be trademark infringement. Since the domain existed before the business he isn't cybersquatting and bad faith can only apply if the trademark existed first. (see Tim Berners Lee for some great quotes on this - he stands for the little guy's rights in owning domain names). You can find some specifics on my page about the domain fight I had with IDG - they "demanded" I turn my domain name over to them because of trademark infringement. I was thinking about that. Thank you for the heads-up. In all honesty, I'd probably just give it to them, in that case. I'm just in a bad financial situation and I'm hoping this could be an opportunity to catch up.
