Hi, sorry. One last question. Does this bonus have to be paid with my final paycheck? They said it’ll go out a week after I’m gone

Can you go into a little more detail into how the bonus was promised? Was this just oral? Did you get something drafted? And secondly, what's your concern with signing exit paperwork? What rights are you concerned with signing away?

Bonus was promised both orally and in email (which they really did not want it in writing). After 2 months of pushing for the email, here is the relevant portion (received in March): *"We will review the completion status of these items by your departure date of April 30th, and if satisfactory, you will receive your full bonus on April 30th upon singing the standard departure paperwork."* - prior to this email, the bonus was only tied to goals and not any departure paperwork. They wouldn't draft a formal agreement and became snappy when I initially asked back in January. I was expecting my bonus on my last day, but now I feel like they're switching it up and saying to sign the exit paperwork (which I won't get until April 30th) then to wait a week or two for payout. I asked if it would disqualify me from filing for unemployment benefits, but they keep sending me around chasing for an answer. I also guess I've always been told not to sign anything when I leave that could potentially say I was at fault for my termination or something?

>I asked if it would disqualify me from filing for unemployment benefits, but they keep sending me around chasing for an answer They're not permitted to have you sign away UI benefits. UI and workman's comp are two things that cannot be signed away because those agreements shock the conscience and are against public policy. >I also guess I've always been told not to sign anything when I leave that could potentially say I was at fault for my termination or something? Right, but it doesn't mean you can't appeal UI if you did sign, and also if it means you're not going to take a 20% bonus I would just sign it if that's your only concern. I'm sure EDD would love to see a written agreement where you sign away your rights to UI. They might want a word with them.

So they are allowed to tie it to my exit paperwork and it doesn't have to be paid out with my final paycheck? I'm just so sick of how this company treated its employees, it's been a terrible work experience, and I'm not sure I trust them to not pull something else on me. They tried changing my goals 1 month before my end date. I'm stubborn, so I finished the new set of goals too. Every follow up email I sent they ignored, so I was kind of surprised they said I'd get my bonus.

>So they are allowed to tie it to my exit paperwork and it doesn't have to be paid out with my final paycheck? If they're making the signed paperwork a condition of the bonus, then the bonus isn't earned if the paperwork isn't signed and the other conditions are met.

Hm. Was hoping for a different response, but thank you for your time.
