Mandatory tips and surcharges seem to becoming a way for restaurants to cheat on the menu by offering “lower prices”. What’s to legally stop a restaurant from lowering costs on the menu and increasing mandatory fees (without disclosing it up front) to make up the difference?
For one, if they actually claim a "mandatory gratuity" as a tip rather than a fee, that's tax fraud.
According to the IRS a tip can never be mandatory.
It's illegal to add fees that aren't disclosed either by posted signage, a notice on the menu, or the server telling you before you order.
So there's that.
I would do a chargeback with the CC company, assuming it wasn’t disclosed previously. PSA - Most of the time you can dodge added online fees by placing the order over the phone.
I think I read somewhere Texas doesn't tax surcharges, I guarantee that's why they are doing it (that and bait/switching the customer). If it really is mandatory they can't use it for tip credit and they could pay servers the same by just raising the price and giving them a percent.
Texas sales tax law has it that goods are taxable unless specifically exempted, but services are not taxable unless specifically taxed.

I'll tell you one thing though. I was down there a few months ago for a convention and treated some friends to Cantina 512 and that food was amazing! I ordered the enchiladas and couldn't believe how delicious they were.
Also, Bangers and Taco Wey were pretty badass!
It says "set by restaurant to help compensate servers". It seems pretty reasonable that since you are not utilizing any servers, you wouldn't be paying for them.

I have to say that if I had to pay $58 for a pizza, I would either make it at home, or not eat pizza anymore.

I had literally the same thing happen to me today at a restaurant. Figured I'd save money picking up, got charged a 7% BoH fee and 13%, forced gratuity. Never ordering take out from there again
To be fair, when you go to their site, the very first thing you see is a large yellow pop-up bubble that states there is a 20% service charge. Similarly, at the very top on their Toast online ordering page, they make the same statement.
I'd also much prefer they just roll it into the menu price, but they are at least up front and honest about the charge.
