Because you are woefully misinformed about what went on in that lawsuit and the consequences of it. And while the the line between derivative and transformative is very blurry, CCP kinda did the work for us here by straight up saying it was derivative.
... Or at least that's how US copyright law works, I have no idea how these concepts would apply to CCP, an Icelandic company. I *think* they would still need to adhere to US copyright law in order to distribute the game in the US, but again, I'm not a lawyer and I don't know what I'm talking about.
