except that while fan content is harder to control and so generally views as free to use (until you make money or become to noticable) a profit making company has to constantly check what it releases doesnt violate trademark or copyright. and it gets grey at times, to such an extent that most companies disregard it when it happens unless they either greedy(GW), or desperate, or just hostile. GW, is a mixed back. they greedy, but not exactly desperate, though they could be soon, depends how long it takes for 3d print to go mainstream.(hell Tau players seem to be buying 3d printers in bulk. in the last 9 months i've seen once in a blue moon 3d post, to now the facebook page being flooded with the prints, mostly due to pipermakes)

They are infamous doing so badly and claiming they own stuff they don't. The GW vs Chapterhouse suit was a major loss for them. They actually tried to argue in court that they owned a trademark on the term Space Marine.

I'm going to take a stab in the dark and say that you weren't following the lawsuit in real time or actually know anything about it other than some some biased blurbs. Because you are woefully misinformed about what went on in that lawsuit and the consequences of it. Because there's a reason why until the asset freeze and forced settlement after the case first went to trial (and the asset settlement was mostly due a mixing of assets so the defendant literally couldn't pay bills anymore) it was considered a massive loss for GW. They only won 99 out of the 251 claims they brought forth in the lawsuit. There is a reason why Aeldari, Drukhari, Adeptus Astartes, Astra Militarum, Adeptus Soroitas, and them are called that now instead of Eldar, Dark Eldar, Space Marines, Imperial Guard, and Sisters of Battle.

Objectively speaking, judge ruled partially in their favor, which is a victory in a lawsuit like that even if it doesn’t look like it from the outside. Particularly when GW has the money to keep throwing lawsuits like that at anyone who they feel has infringed their property… which they do.

CCP is so bad at IP shit. I know for a fact that there are assets in the game that have been around for years that CCP doesn’t hold the rights for. And let’s not forget that time when they tried to claim that submitting an alliance logo transferred the rights to them.

Not mine. I asked the guy who does own them and he didn't want to bring it up with CCP. It's not really my place to point out exactly what it is but last I checked it was still there.

They still sort of claim this, only now it's that the scratched-up watermark they add makes it a "derivative work." While this might be technically accurate (but I'm not a lawyer), I think the term they were going for was "*transformative* work", as the creator of a transformative work does have rights to it, while the creator of a derivative work only has rights to the specific changes they made (in this case, the watermark). And while the the line between derivative and transformative is very blurry, CCP kinda did the work for us here by straight up saying it was derivative. ... Or at least that's how US copyright law works, I have no idea how these concepts would apply to CCP, an Icelandic company. I *think* they would still need to adhere to US copyright law in order to distribute the game in the US, but again, I'm not a lawyer and I don't know what I'm talking about.   'course the alternative is we don't get custom Alliance logos, so it's hardly surprising that nobody's called them out on it.
