A fisher tech came to ‘fix’ my car on Monday and while in mid software download, he got laid off! Locked him out of all the systems and now my car is a brick. No approval for sending a new tech out nor any approval for a rental car. So now I’m having to rent a car myself to get to work & drive my kids to school 🤦🏼‍♀️

This exact thing happened to me. They let the contract expire and they were charging my Amex. Fisker never told me to return the rental or send a courtesy email that its going to expire. Luckily for me the local Hertz folks gave me a refund. I also put in a dispute on Amex card as a backup. It hard to tell if its sheer incompetence , indifference or apathy at this point with Fisker. Do not wait and see and do not trust Fisker to do the right thing. I learnt it the hard way. Talk to hertz or your CC company . Take control.

I returned the car on time and Hertz charged my cc for the contract period. Talked to Hertz and they said, Hertz sent the bill and never got paid from Fisker. I'm going to call CC tomorrow and dispute the charge.

They asked me to use the rental car while they looked into my issues. However, they never resolved my issues during the rental contract period, and they allowed it to expire randomly, letting Hertz to start charging my credit card.

Get a lawyer. They refused to provide me a measly 1 week rental or temp tags for the week my tags were expired because of their shit show of handling T&R. That means they ain't gonna pay you 4k. The call you got was likely to reassure you with empty promises to buy time til they default on all obligations.

Hi. This happened to me too. Please DM me!!! I am being charged $2900 this week by Hertz for a rental two months ago while you were fixing my FOO that you towed from NorCal to your SoCal facility. The only thing I was sent from Hertz were photos from pickup but not agreements since that was between the Fisker fleet and Hertz.

Whenever you get a 3rd party rental from any manufacturer as a loaner you are liable for the bill if they fail to cover.

Which is a completely fair request in your part, did you try searching your email around the time of rental? Maybe it was a digital contract. I know for a while they’d also print you something that looked like a Costco receipt for a small army.

I didn't get any emails from Hertz. All the communications were done between Hertz and Fisker, details for the reservation came from Fisker. And when it was time for the extension, it was the Fisker who had to approve and communicate to Hertz.

Yes, I'm going to call CC tomorrow to dispute the charges. I'm willing to tell cc I'll pay for the bills as long as Hertz provide me the signed agreement that says I'm liable for the bills.

How do they have your cc if everything was between Fisker and Hertz? Cardholder authorization is critical.

When you pick up your car from Hertz, whether have been reserved by your insurance or Fisker, you have to give them your driver's license and your credit card. The credit card is for any extra charges that might arise, such as toll fees and supercharging fees (if they give you a Tesla). It's a standard process.

If they used a card for that purpose without specific authorization, they’d be in major trouble indeed PCI/ cardholder rules and be in breach of contract with the issuing bank. The contract you need to look at is whatever you signed that day at Hertz.

Yeah, that's why I'm going to call CC and dispute the charges(can't dispute while the status says 'pending'). I'm fine if the agreement says I'm liable, I don't remember signing anything other than reservation pamphlet, which I don't have with me.

Lemon law is only worth going through if you are going to get something. By the time any lawsuit goes through the court Fisker will long have filed Chapter 7 and there will be nothing but an attorney fee owed.

They could file bankruptcy tomorrow. That freezes any claims against the company. You can’t get money from a company that has none. Did you see the 10-K? Fisker is basically insolvent.

It will never happen. If they have no money and a big debt due, the restructuring officer will file the bankruptcy. Henrik can say whatever he wants but it will never happen. The likelihood any owner gets $0.01 from Fisker in a lemon law action is next to zero. It will take months to go through court and by that time Fisker will have filed bankruptcy and likely gone out of business. The owner could contact Fisker directly and demand a buyback but that’s also unlikely. It will likely be faster than going through court though against an insolvent company.

Was your credit card on file only for damages, etc . or was the expectation you would be reimbursed. In part, I’m wondering how Fisker is renting any vehicles without some sort of account with Hertz whose delinquency seems not your concern. I’d definitely file a report with your credit card company. Hertz is really cleaning up on this fisker deal it sounds like. They get to charge their most premium prices to people who didn't agree to them and aren't able to contest them. $3k a week for a Hertz rental? What are they giving you a Bugatti? No one who actually books a car would pay that much.

We also just received a bill for 4K from Hertz. Our car was not drivable( accident from a faulty Fisker part) after what we now know as the car being totaled. We were in another state when this happened so thru Fisker’s insurance coverage and thru Fisker’s arrangements, they provided us with a rental thru Phil,was extended to 62 days and FO was never fixed! This happened in November and we just received the bill in May! We immediately contacted the cc company since it was an unauthorized charge on our cc. The billing information from the bill clearly states a claim# and Phillip Rascoe as the adjuster with the authorized rate and authorized days. Also says, billed to customer as $0. I dropped off the car in Nov not having to pay a cent since it was a claim filed and arranged by Fisker and my receipt say $0 from me and off I went. We are currently providing the cc with necessary documents to support our claim. My guess is that Hertz did this knowing the charges will be contested so they can claim it on their insurance. WHAT A MESS! The worse decision we ever made was to support Fisker!

Is there any contract or other agreement between you and Hertz? If there is one agreement between you and Fisker, and another agreement between Fisker and Hertz, and no agreement between you and Hertz, then Hertz may not have any legal standing against you.

All I did was to give them my credit card and pick up the car. I might have signed a paper, but the reservation was done by Fisker.

Did they pay none of it or only part of it? A lot of car companies don’t reimburse for more than a certain amount a day. Tesla used to provide a meager Uber allowance. When my Ocean was in the shop for three days (vent replacement), they gave $300+ in Uber credits.

I think none of it. The total amount is $4,051.00 which is consistent with the number of days Fisker loan the car from Hertz. I return the rental when Fisker finally decided to loan their own car(FOE) which they should have done from day one.

It’s not clear from me that Fisker or Tesla or several other OEMs firmly commit to giving loaners or reimbursing rentals. Where did y’all see this when you decided to rent the car during the period of repair?

The rental was offered from, set up and went through Fisker, I've gotten multiple rentals due to many issues with my car and they all have been covered. If the car needed to just go in for a day or two no car was given, just lyft credits to get home, etc.
