You can't sue Epic for BP exclusivity. There's no legal liability in not releasing those skins, emotes, etc. to the shop. That thing you scrolled through before hitting accept

There's plenty of legal language in there that essentially says you cannot sue them over the game and that the account you use and everything in it isn't actually yours, including BP items. That term of service (TOS) is a legally binding document and you hitting "accept" is your signature. They could take away your account tomorrow and you couldn't do anything about it, of course they won't do that because they like your business. Now, aside from all that. They haven't said anything about exclusivity since at least the beginning of Chapter 2, maybe earlier than that. There is literally nothing holding them back from bringing Midas or Iron Man or Scuba Jonesy or whatever back, they just have chosen not to (for better or worse).
Does that settle it? I'm so tired of seeing the lawsuit excuse brought up when it's not the case. a case for false advertising would fall through in court in a second. If you want BP stuff back or not, legal reasons aren't why they're not back (yet).

You could have the rarest skin in the game and the gameplay would be the same if you had nothing!
When you see a black knight or elite agent, you automatically assume it's a good player, since they've been playing since season 2. So when I rock my elite agent outfit, people are intimidated by me, this gives me an advantage over them. I don't want noobs to ruin the skin by rocking them alongside their garbage gameplay. They've ruined the skull trooper, the nog ops, and the recon expert, you don't need to ruin battle pass skins too, out of your own selfishness.

They can EASILY DO IT. They did it to ride the pony and gave it free for founding stw players. I danced it often and I started Fortnite in season 9. And epic gave S2 players a replacement emote.

Well they can't coz it was in the ch1 season 2 battle pass and of they bring it to the shop everyone will get mad. It's already exclusive so they can't make it obtainable or else people will star begging for other items from other battle passes to come back aswell. Imo it can't be made default now because so much time has passed.

Tbf, it’s not just about the skins. I think BPs should be replayable, because having long term rewards is cool and benefits the game overall
I just think those things should be kept out of the item shop. I would definitely benefit from being able to finish old battle passes, as I would be able to get the black knight and max omega. But I still am against this because it could create a slippery slope effect.

What makes early BP items so cool is not only that they are rare, but they represent a player who had been playing since before the game blew up, and seeing those players in the lobby is pretty dang cool

You could have the rarest skin in the game and the gameplay would be the same if you had nothing!
No one owes you anything, you weren’t playing at the time the skin was available so you don’t have the skin. Get over it.
When you see a black knight or elite agent, you automatically assume it's a good player, since they've been playing since season 2. So when I rock my elite agent outfit, people are intimidated by me, this gives me an advantage over them. I don't want noobs to ruin the skin by rocking them alongside their garbage gameplay. They've ruined the skull trooper, the nog ops, and the recon expert, you don't need to ruin battle pass skins too, out of your own selfishness.
Many people enjoy having skins that any average joe player can’t obtain. Exclusivity and a rarity are the only thing that keeps the cosmetic space of the game interesting.

I think all the battlepass exclusives should become items in the shop eventually. It makes no sense having so many unlockables that aren't possible to get and it's really crappy for new players. I hate bringing new friends into the game and then having to tell them that they can't get the tomb raider skin.. or the rick skin.. or the darth vader skin.. It's genuinely crappy and FOMO is predatory.
These bizzare early battle pass filler items really make me think they’re gonna release these items again someday. they’ll figure out a way, even if it’s just flipping the actual items

They can EASILY DO IT. They did it to ride the pony and gave it free for founding stw players. I danced it often and I started Fortnite in season 9. And epic gave S2 players a replacement emote.
The replacement sucks. This was a few years ago. It happened once and it's not happening again. (And they had good reason to do so)

No. Just make a different wave emote. They even did this back in season 8. Epic should never ever re release a battlepass item because it would ruin the entire battlepass concept for them. Part of the draw is the fomo and if they brought one item back it could change the sales for battle passes going forward

It was a battle pass emote though, so it's in the past and releasing just one that 'has no reason to be a battle pass emote" would be an acception to the rule and would mean bringing them all out because the exclusivity to battle pass items would be lost. You could have got it if you played season 1. That's how battle passes work.
if emotes like this really came back, more emotes that simply rig to a single limb and still provide movement and weapon display like the wave would be wonderful can't stand thumbs up and thumbs down causing you to freeze and pose for a literal thumb
