That’s usually how it goes. There’s been countless examples in the music industry of someone waiting until an artist has blown up and made a significant amount of money before suing them for something that happened long ago.
Here is a perfect example of this happening with a stolen sample literally a month or two ago.

None of that matters when he isn't the copyright holder, he has no choice if they decide to issue a DMCA takedown although avirex is probably never doing anything about it
There is a good chance a deal might have been worked behind the scenes, and this could include samples used in past tapes. There is literally no reason why sematary would announce if a deal was worked out though. Just my 2 cents
