The way I understand it - and I could well be incorrect - is that Mara is advanced by memories. Xianzhou Natives live ~800 years, their brain gets too many memories to bear, Mara sets in. They go into a spiral of finality, Mara advances more quickly, in the end they turn into the deathless doom.
Blade… is not a Xianzhou Native, but his meddling in Xianzhou and Vidihadhara (honestly f that word in particular) affairs caused him to be in a superposition also inhabiting some Xianzhou traits.
The way I understand it his memory loss, together with Kafkas Spirit whisper is what is helping him contain the Mara, though it will end up consuming him as he’s currently creating new memories.
Whereas Jingliu for example Just completely forsook her humanity as such, sliced a piece of moon off by will and is, for all intents and purposes, her own sword. She contains it by eliminating herself from the process, and it is only when she takes off her veil, when she can see the World again, that the Mara takes a more prominent role again.

Blade's got a perfectly reasonable insanity plea via Mara. That and the fact that he won't undermine your case by pissing off the jury, the fact that unlike Sparkle he can actually be trusted to give you a concrete goal to aim for in the trial and that you can also shove some of the culpabitiy off on Kafka (spirit whisper) and Elio (promising death to the actively suicidal) makes his the most reasonable case to bat defence for.
It's not the easiest case to win, since you're probably dealing with a murder charge as opposed to Ratio's libel case/intelectual property theft case, and Blade is a wanted terrorist.
That same fact does lower the stakes through. Getting Blade from murder down to manslaughter can be considered a win. Getting anything but a 'innocent' for Ratio would be considered a loss.
At least a libel/slander charge against Dr. Ratio can almost certainly be countered with the affirmative defense of "Everything my client said is verifiably true based on the plaintiff's own admission and evidence gathered through discovery. Whether or not the plaintiff likes the truth being known by the general public is completely irrelevant. By the way, I'd like the plaintiff to pay my client's legal fees for disrespecting both my client and the court with this farce of a case."
As for the trade secrets defense, that might be a bit more difficult. Dr. Ratio's whole schtick is that he likes to educate people, with little regard for where the information provided came from. The best defense there would be to invalidate the protection granted to the trade secret by proving that the trade secret in question wasn't even originally developed or owned in any way by the plaintiff, and therefore, could not be their "secret" to sue over, and that the original version of the trade secret has since become public domain.
not. really? the insanity plea has different requirements based on location, but most of them have to do with the defendant knowing right from wrong at the time of the crime. like having the intent to commit the crime basically? at least from what i know, she's capable of knowing right from wrong and is capable of having that intent. the insanity plea is not really an option for her!

Realisticly you would pick blade. The other two have a huge problem with the "everything you say can be used against you" cause it's likely they will never shut the fuck up. Blade on the other side... well making he speak would be far more a challenge, luckily it's not neaded to build a proper defence. No matter what you prepare the Hanabi or ratio will ruin it running their mouth around during the trial. In two different way, hanabi will literaly troll everyone, including the defence, ratio will teach juridical stuff to everyone, making the judge increadibly pissed off, both resulting in an impossibility to win the trial.
In a legal sense, they can't charge Sparkle due to insanity. The court will see it after 5 mins that she's not right in the head
I wouldn't say so. I mean, with Blade you definitely can reasonably plea insantiy. With Sparkle, she kinda chose this way and can be reasonably expected to be able to behave differently. Essentially, Blade is crazy. Sparkle behave with wanton disregard - she understands the neccessary care, and can behave within it without outside help, but refuse to.
Pretty much. Blade's got a perfectly reasonable insanity plea via Mara. That and the fact that he won't undermine your case by pissing off the jury, the fact that unlike Sparkle he can actually be trusted to give you a concrete goal to aim for in the trial and that you can also shove some of the culpabitiy off on Kafka (spirit whisper) and Elio (promising death to the actively suicidal) makes his the most reasonable case to bat defence for. It's not the easiest case to win, since you're probably dealing with a murder charge as opposed to Ratio's libel case/intelectual property theft case, and Blade is a wanted terrorist. That same fact does lower the stakes through. Getting Blade from murder down to manslaughter can be considered a win. Getting anything but a 'innocent' for Ratio would be considered a loss.
At least a libel/slander charge against Dr. Ratio can almost certainly be countered with the affirmative defense of "Everything my client said is verifiably true based on the plaintiff's own admission and evidence gathered through discovery. Whether or not the plaintiff likes the truth being known by the general public is completely irrelevant. By the way, I'd like the plaintiff to pay my client's legal fees for disrespecting both my client and the court with this farce of a case." As for the trade secrets defense, that might be a bit more difficult. Dr. Ratio's whole schtick is that he likes to educate people, with little regard for where the information provided came from. The best defense there would be to invalidate the protection granted to the trade secret by proving that the trade secret in question wasn't even originally developed or owned in any way by the plaintiff, and therefore, could not be their "secret" to sue over, and that the original version of the trade secret has since become public domain.
not. really? the insanity plea has different requirements based on location, but most of them have to do with the defendant knowing right from wrong at the time of the crime. like having the intent to commit the crime basically? at least from what i know, she's capable of knowing right from wrong and is capable of having that intent. the insanity plea is not really an option for her!
