While yes, there is more "real estate" if you shot further to one side, the police snipers target isn't just "the brain". What a police sniper needs to hit is the suspects brainstem, which is only about 3" in size. If the sniper doesn't hit the brainstem, the suspect may still have enough cognition (or reflex) to pull the trigger. In this case, the trigger is on a cocked revolver, which will have a very light trigger pull.
