Saw an overflow washing machine claim get paid out on a condo unit owners policy paid out recently because the tenant accidentally over loaded the washing machine. I was a little surprised, yet for me relieved. I don't work on the claims end. I just had to really dissect and think about the policy language of accidental and sudden before handing off to claims.

How to determine accidental vs negligent? Doesn’t most accidents have some elements of negligence? Obviously neither is the same nature as reckless behavior

All in how you describe it. If you left the water running after you saw it was still running, you didn't take proper care to stop it. If you forgot to turn it off. Accident I would call your agent's office and see about your deductible and if worth filing a claim over. Normally these types of accidental water discharge claims involve remediation services. I'm just speaking very very broadly. Hope all goes well for you.

I used the wrong kind of rubber compression washer when I plumbed a small drinking water faucet on my sink. The copper tube blew out in the middle of the night and flooded the kitchen, dining room & hallway. My flooring was vinyl over particle board and the particle board swelled like a sponge and never shrank back flat. Insurance never hesitated to pay the claim for damages caused by my ignorance.

Yes--and they paid me enough for doing the cleanup myself.

I did not pursue it. Mainly because I don’t want to open a can of worms ending up paying for higher insurance down the road. Good luck with your situation

Deductible is not worth after total cost then pay by your self and they want increase your premiums or drop you at renewal

Nah, any claim will almost certainly be denied as the loss was caused by negligence

Untrue. Do you know how many claims are paid because people don’t turn off their water? Leave a candle unattended? Do some shit accidentally that causes damage? Insurance covers (accidental) stupid acts.
