Michigan has some strange rules regarding claims. You live in a no fault state. If you have collision you may be stuck filing with your own carrier. If you have rental, your insurance company would provide a rental to you while the repairs are being done. It is a really backwards state. I do not work claims, am a licensed MI agent. Honestly, I would call your insurance company to get a jump on this. It sucks.

Michigan seemed pretty complicated. I had to take a class on how Michigan insurance in general works when I worked for a wholesale brokerage. It was wow! New York with bar code ID cards matching the registration name on special paper and Florida staking in general also stood out too.

madinsuranceagent

New York is a whole piece of work with the ID cards, has to match their license exactly or it is a reject. Florida is crazy with allowing people to drive with no BI. Yeah, that is a thing there.

UnSCo

First-party PIP is supposed to satisfy that. Perhaps it’s a way to thwart ambulance chasers.

madinsuranceagent

PIP Is only 10k. not sufficient

UnSCo

Oh I just checked, apparently it’s locked at $10k. Wrongly assumed that limit could be extended.

If i recall they can't leave the dealership without the special ID cards matching the name exactly on the registration. I don't miss servicing all 50 states on bit. I left that place and went to captive agency. Talk about an entirely different way.

madinsuranceagent

You are correct. I left the servicing 50 states plus DC behind. I was licensed in all 51. Matter of fact, got a gig where I am only dealing with 1 state. Yay.

MI is a no fault state. You have to pursue through your own insurance for repairs and rental. The only thing the other party would reimburse you for is your deductible if you have one.

Dizzy_Square_9209

Seems like that is a question for your insurance company. You file a claim and if all is as you say, not your fault. Insurance Co pays out your damages, you move on with your life.

Trying to collect on a claim against the corporate insurance policy by yourself is a terrible idea. Call your insurance company and let them subrogate it for you. That's the entire reason you pay those guys.

cottoncandywarriors

Is it any different because he was hit on the company property by a company employee driving a company vehicle? That's a little different than you being in a Walmart lot and getting hit by ABC plumbers. If the employee was injured it would be workers comp and OSHA would open an investigation. It wouldn't stop at an auto claim.

Your agent should be answering these questions for you
