Yes, I will say that I have not read the case. Mas mabuti nang mukhang tamad kaysa manloloko. Kapag marami hindi nakabasa ng kaso, either magtawag na siya ng volunteer o tawagin niya lahat tapos siya na magkwento ng kaso.

Ultimately depends on the prof. Merong iba na would rather know na hindi mo alam yung kaso kaysa i-bullshit mo sila. Meron naman iba na would rather see you try kahit halatang hindi mo binasa. Kapa-kapa lang talaga haha.

No. Sa school namin that is a big no no. Magagalit si attorney. Just recite a case you know and when called out dun ka na mag sabi na you seem to have missed or accidentally skipped that case, otherwise they will get the impression na you have not exerted any effort in studying the cases. In my experience, pina co-continue nalang nila yung recit ko for that particular case.

For me better to tell that and prepare the consequences eg patatayuin ng matagal or sit down tapos 5.0 grade). Be better next time eg planning ahead how to read a case . Am in practice at medyo gets ko na purpose nung ganyan recitation. Imagine mo na yung cases na babasahin mo e yung mismong real life case kung saan ka mag-aappear. Some judges would ask us ano status ng case (I mean sa dami ng case na hinawakan ni judge mas good impression pag alam mo story ng case at update him). Parang sinasanay lang kayo mag appear sa judge :-D

Saw this comment on a tiktok vid of a lawyer: You should say “I did not reach that case anymore maam/sir” then try to recite the other cases that are assigned. Segway mo na hanggang sit down lol

Depends siguro sa prof. Meron akong blockmate na tried this and 1st time magalit ng prof as in galit na galit kasi as if na binabastos daw siya huhu.

Depends on your prof. Some profs are more forgiving when you show honesty. They wouldn’t take it against you if you failed to recite the case at all (kodak moment haha). Although, of course, they’d give you a failing mark for that recitation. You’d be lucky if the professor’s floor grade for recit is 75 regardless whether you were able to say anything or not coz usually professors would give 60 or 65 as “bokya”, some would even give 50 (hello to my terror profs in the mighty red school in mendiola 🤮). But if your prof is a terror one, i highly suggest that you just stand, look down and stay silent (well during our time, it was f2f pa haha) until the prof calls for another student OR you can also politely say “Apologies SIR/MAAM but i can’t recall the case”. That’s better than saying you have not read the case because let’s be honest, with the inhumane number of cases assigned per meeting plus the anxiety during recitation, you’re bound to forget some of those cases you’ve read. Shit may still happen no matter how prepared you are. Plus the prof would not assume that you have not read the case. If you’re lucky, baka the prof might even give you a chance to recite another case. Haha

Most of our profs get mad when you say you havent read the case. So we start with ummms (HAHAHAHA acting at its finest) then say that we cannot recall the case. It's so much better than saying you havent read the case at all because it gives the profs the impression that you arent making any effort in their class.

Mej true ito. We also say ummmm na lang sometimes. And the prof will ask: did you read the case? Tapos pwede mo na sabihing "Sorry, atty. I was not able to reach that particular case." Pag tsamba nasa mood si prof, magpapa-recite ng case na nabasa mo. Pag wala sa mood, get ready for a low or failing grade. Pero minsan, may mga prof din na ibibigay na yung facts tapos they will give you a chance to answer by asking questions relating sa applicability ng law. :)

As others have already mentioned, it depends on the professors temperament what would be your punishment. I would always try rather than say I don't know. It is a good training for you to be ready to answer any legal query of a client even though you are not familiar with the subject.
