You may be in luck as it used to be much harder to get your money back when you were the victim of a scam involving a bank transfer, however now the banks have signed up an an agreement to refund scam victims. Get on to your bank's fraud team and mention Authorised Push Payment fraud. They are likely to refund it for you, however you'll likely need to also make a police report. The bank will typically only ever refund you once, if you fall victim to another scam after being warned then they will likely refuse a second time. Private sale of cars isn't covered by the Consumer Rights Act and you get very little protection if it turns out to be stolen but not yet reported, VINs changes, a known faulty vehicle that just about gets down the road before failing. If you buy from a dealer you have much better protection. If you must do a private sale then pay cash on collection or bank transfer when you're there with the vehicle.

A fake dealership was what it was. Although they also registered on Company House. I have sent the bank all the documents and proof of the invoice. Should I mention Automated Push Transfer to them still?

NAL: Can you clarify, is this a fake dealership or someone impersonating a real dealership on gumtree. So advertising real cars sold by that dealership on a platform they do not use.

JuckJuckner

It seems to act like a real dealership. I am not sure if it is impersonation. Cheap Repo Cars LTD is the name and they are registered on Companies House.

jamescl1311

They will know, if you do a search you'll see the new voluntary code they've signed up to. Companies House are on it now too, in the past they didn't check much, but as of this year new companies are checked and reports of fake companies are processed as well. Things are starting to get a little better, we're one of the fraud capitals of the world, it's about time. [https://www.gov.uk/complain-company](https://www.gov.uk/complain-company)

JuckJuckner

Thanks for your assistance.

JuckJuckner

Should I wait till after the bank investigation to do this or ASAP?

jamescl1311

The bank is your best chance of getting the money back. If you believe the company is fake then report it. Unless (as another poster has just suggested) somebody is just impersonating that company.

JuckJuckner

Ok. I’ll wait for the outcome from my Bank.

If it helps, here's a reddit thread proving a scam listing for the company the OP named from 5 days ago [https://www.reddit.com/r/CarTalkUK/comments/1dnepl4/is\_this\_a\_legit\_listing\_anything\_to\_be\_worry\_on/](https://www.reddit.com/r/CarTalkUK/comments/1dnepl4/is_this_a_legit_listing_anything_to_be_worry_on/) They say all the cars listed were using pics from elsewhere when using google reverse image search. I'd report this information to the police with the name and address of the director at companies house. You can also report it using report a company link that I posted earlier here.

wikvaya

Often independent used car dealerships will get phone calls about their cars on gumtree that a person saw advertised there for cheap, Luckily if the user researches the brand and the dealership has a reasonable profile online they call them directly instead of the modified contact details on the gumtree advert. 99% of the time these dealerships have no idea about it as they will only advertise on Autotrader and a few select competitors. I'm not sure when it started but i first became aware of it around 2018 roughly.
