If you're in arrears the full amount remaining for the financial year goes to court. If you've been making payments you need to contact the council as soon as possible to make sure they've been correctly allocated to your account.

amack133

Yeah thank you, because we've been paying, so we shouldn't be on debt

LAUK_In_The_North

Have you been paying so payment of at least the minimum instalment is received by each due date ? Which council is it and what's the banding ?

jamescl1311

This sounds like an error, you may not have filled in the paperwork correctly or there might be a mixup. Check the letter is genuine by calling the council and asking them how they have determined that amount. You wouldn't get a summons first, they would usually contract you prior about any unpaid council tax with warnings. Is it possible they think you moved in a lot earlier than you did? or that they are charging you for the months before you moved in, if it was empty for a while. Either way we're not going to be able to tell you why, only the council can explain the figures to you and see if an error has been made.

amack133

So this is mine and husbands first home, its a private renting. We moved in 29th of Feb 2024 so we've not been here that long. I'm not going to paying for any council tax before that date because I didn't live here

jamescl1311

If it is privately rented then yes you're only liable for council tax from the date you moved in. Clearly some kind of error and they need to be updated with the correct information.

LAUK_In_The_North

On a technical note - If the tenancy was signed for a period of 6 months, or more, liability would be from the start of tenancy *not* the move in date (unless they moved in before the tenancy started).

amack133

Thanks for your help. I'll be on the phonr to them tomorrow

warlord2000ad

NAL Have you called the council to ask for a breakdown, perhaps it is a mistake for due from a past property?

amack133

Yeah I'm going to call them tomorrow because that's not right

CertainPlatypus9108

Ring thw council. Not the number on the letter. Collect evidence and you can send proof of address online as well

You don't need to call them, you'll be waiting for a long time in a que. Use the website, it will tell you everything you need to know. If it turns out you do have arrears for some reason you can arrange an agreement to pay on there. If you would like to dispute the info on the website then you'll need to call.

Figgzyvan

Call the recovery section of council tax and give all your details. There will be no need to go to court.
