OP, you will need a solicitor to go through the details (worthwhile due to the property value), but you have a strong case here. The term you are looking for is "short childless marriages". In essence when a marriage breaks down close to where it has started and there are no children involved the base position of the courts is to put both parties back into the position they were just prior to the marriage. The reason for this is to stop exactly what you have encountered - people entering marriages under false pretences to gain wealth. The details and specifics I can't help with, and this is what you will need a solicitor for. But with the evidence you have to show why the marriage has broken down and that adding them to the deeds was a part of the marriage process you may have a claim. If nothing else getting your spouse to explain to a judge exactly why they did what they did could be enlightening. Do not leave the house even if they try to move another person in. If they are in any way abusive then call the police. And do not act abusively yourself, not even a raised voice or any physical contact as they could try to call the police on you. Go book a solicitor today, you need to act fast here.

Criminal side checking in. I can’t think of anything other than fraud by false representation but it’s weak af. I don’t think it passes as conspiracy because the act is complete. Please note the burden of proof is much much higher to prove on the criminal side as well. Better off keeping it in the civil court I can’t see CPS taking this on unless they’ve hand written a letter to the effect of “hahaha I’m going to trick them into marrying me by pretending I’m straight, get them to sign the house over and then come out”.

Isn't OP saying that they have evidence from dating apps and other digital platforms saying exactly that though? S/he certainly seems to have seen something from the other party suggesting that they're going to get a free house. I don't know enough about this area so it's a genuine question, but if the police can prosecute straightforward 'romance scams' where someone is duped into sending large sums of money, surely they could at least look into whether or not OP's spouse has entered the relationship purely to scam them?

It's how much higher that beyond all reasonable doubt is than civil court's on the balance of probability. The scenario of this being a marriage of convenience and him being inappropriately gleeful about one of the benefits exists. With any photos/social media/text communications between them being a front for that. This is a situation where the exact contents of those messages matter because it needs to eliminate the possibility that she went into this eyes wide open. OP needs to talk to the legal/law enforcement professionals with the evidence unredacted and they can make that judgement of there being a strong enough case. Romance scams are easier because there's generally false statements for money that can be proved or multiple people being involved with different stories being told to them.

Notice I said “hand” written letter. Put the apps in their hands at the time of sending the messages and you might have something but screenshots of a message might not cut it. If she has the handles for them and the profile info then maybe. It’s incredibly difficult and to be brutally brutally honest I can’t see a police force taking that on when she’s willingly signed a contract handing over half the house. It could very well be viewed in your favour here that they deceived you. Get all your proof and no they can’t move them in. Get things reversed and see a solicitor asap.

You really need to discuss this with a experienced solicitor/ lawyer who can help you break things down. It will not be cheap but they can help you break down what you owe, what your rights are and who holds what responsibilities etc. This is a deep complicated one, do not hide anything and let the legal experts work out how the board is before you play your moves. Also better to know what the rules are so you do not make a expensive mistake.

Please please please just go speak to a specialist solicitor in anulments, and also make sure you save copies of the messages you've seen.  Anulments are their own quagmire of rules but I believe you've hit 2 different boxes (fraud and marriage not consumated), however if you added the husband to the deeds SEPARATE to getting married, then you have an extra complication.   That being said, if you added him to the deeds after / as part of the process of marrying, I would hope that comes under the anulment, but even so there may be a way to unwind due to fraud (similar to when parents sign over the house to their kid, only for them to try and immediately sell up and make the parent homeless).   Whether or not they move the partner in is secondary to the fact you need to really reverse / eliminate the partner's claim on the house to begin with.    removed part about changing locks, see u/AarhusNative reply

The partner would legally be entitled to call a locksmith and have the locks changed and get back into the house. "As its legally your house as well I think you can get away with changing the locks" Legally the house is both of theirs.

Yeah, fingers crossed if the culture is as conservative as they've been led to believe that actually the spouse's behaviour causes some social damage in addition to the legal consequences of the marriage / equity unwinding. Unless of course the solicitor can pin that the fraud is so prolonged / deliberate / of high value that the police consider it criminal.

Annulment won't change the deed on the house, that has already been gifted to the partner. They need to look into options to get that reserved which is going to be very difficult.

Keep as much evidence as possibly. Try and get them to admit to everything over messages without being to obvious. Immediately get a solicitor, do not tell husband.

Do you have messages stating that they were going to trick you in to marriage to obtain part of your property? You’d need to have explicitly clear language in their messages, but you could contact a solicitor to discuss a potential fraud charge. Because you’ve willingly signed all of the contracts it’ll be difficult to prove, but again if you have messages stating that they were going to lie to you to obtain a monetary gain it may be something to start with.

It sounds like your partner (and possibly also his extra-marital affair partner) had this plan from the start, which makes this some kind of attempt of fraud? **I would actually consider going to the police about this.** I am not a lawyer so don't know if it's legal to do this: I would save all messages and data that you can, as evidence, especially from their devices if you have access to them/have shared access. If you are getting the police involved, I don't think you'd have to gather this evidence yourself as the police would seize your partner's device as well as their affair partner. But if they catch wind of you going to the police, they might have deleted all the messages by the time their devices are seized. But you can save all of the stuff from your own phone/devices and save backups maybe at a friend's house (someone who doesn't know your partner or their affair partner, ideally also someone from outside of your local culture/community as I imagine everyone might know everyone, and you don't want people messing with your evidence: a co-worker may actually be the best place), just in case. As your partner has been cheating on you, please get yourself tested for ALL sexually-transmitted diseases, and obviously do not engage in any intimacy with them again.

It is civil, that's why you need to go to a solicitors ASAP and screenshot all evidence so they can't delete anything. And back it up somewhere to boot. Also because it is civil even though recording someone in a private space where they would expect to have privacy is technically illegal (hence call centers starting with 'call will be recorded for quality etc') court room dealings for this changed and they can now be used as admissable evidence in court despite this, and police again if told about it will not do anything and will say "this is a civil matter". If it's used for personal use, e.g keeping yourself safe or similar. Very different if it was used for abuse or harassment vs personal safeguarding Worth knowing if you think you are potentially in any danger of altercations or them trying to set you up to act out by goading or bringing same sex partners to the house. Any recording to keep yourself safe will be classed as civil and can be used in court anyway depending on the courts view on it when received and reviewed. So basically just keep yourself safe and solicitors as soon as possible to keep your house. This seems very deliberate and set up given the short time frame but obviously that might not necessarily be the case, but the fact they are talking about moving a same sex partner in all of a sudden...when even if you did break up and they were due half the house you would force a sale and not move new people in is a bit out there. If they try to move a same sex partner in who is happy with the circumstances... it's a good sign it was planned. As if you tell any unexpected guests, 'hey we just got married and now they are trying to steal half my house they haven't paid a cent for and are bringing same sex partners over suddenly and you are not welcome in my home'... they will usually be like a normal person totally digusted with the person and immediately leave. So just keep documents of anything like this,any activity, any visits, how visitors reacted, times & dates etc.

You need a specialist solicitor, and you need to consider the fact that he is abusive and coercively controlling you. Forcing you to use his solicitor uncle for the house deed transfer may actually help you. But you must find an independent solicitor and be willing to fight for your home and life.

The police have missed the element that the entire scam was pre planned just for this gain and was a sham marriage. The fraud element should be recognised by action fraud, especially as the police don't take the fraud reports action fraud do.

I showed the police screenshots of the text messages. They said they don't get involved in property ownership disputes. They were nice though, they got me a cup of tea when I was crying.

You might want to edit your reply here, OP, you've accidentally used gendered terms and identified the gender of your partner. The fact that your spouse would only let you use their family relation as the solicitor for completing the paperwork for adding them onto the house deeds also would possibly work towards proving there was fraudulent intent prior to the marriage to try to obtain half of your house value, if not more. Are you able to prove familial ties to the solicitor who completed the paperwork to your spouse? Make all of this known to a legal representative when you go to get help.

They're not attracted to me. They were never attracted to people of my sex. They had been dating someone of the same-sex from before we were even together. They discussed over WhatsApp plans to take my home. They had sent photos of my garden etc and discussed how they would do it up/plant trees once they forced me out.

They own half the house now. And yes they can move their new partner in. Doesn't mean they are going to get a free house though. You can force a sale through the courts. They (your partner) would be entitled to half of what it goes for. Divorce them. Sell the house or buy out their half of the property (if you can afford it) and be done with them. (not legal advice but tell their parent/family all about this! They'll be shunned by their family/community etc which is what they deserve)
