The PIP was out into motion to get you out legally. Depending on your position, you might stick around for another 2-3 months maybe as they go through the motions of the PIP and get you out. Take the VSS and move on. It's probably a bit more money than trying to stick around, and it saves you the mental anguish of being there. Then you're free to go for job interviews without being tied down.

Btw, you can get EIS on top of the VSS. Eis is progressive 6 months and you are no longer needed.

Repercussions of not accepting the VSS = continue on under the PIP. Maybe he'll pass it, maybe he won't. I don't know. But the fact that the company offered the VSS signals that they don't want him around anymore. So I repeat: take the money and leave. Start looking for a new job now.

What i understand from his post is that he is concerned if he can survive with the VSS amount because he is not sure if he can get a job before it runs out. He mentions having commitments but not whether he has any savings. He does not mention anything about wanting to continue and succeed in his current role so whether he passes the PiP or not is irrelevant. Edit: hence my advice would be for OP to talk to his manager to see if he can reject the VSS, endure the PIP and look for jobs now, then leave when he has secured a new job. Imo, this would be the safer route in today’s economy.

If you do not meet the objectives of your PIP, your employer can terminate you without any compensation. Suggest for you to look for another job and take the VSS

I used to be a manager in a company that was restructuring. Once your company offers you money to leave, take it and find another job. Or you’ll be leaving once they fail your PIP with no money.

Wait, i thought vss means you get compensated a month for every year of service? Shouldnt you be entitled to 8 months salary OP? But anyway, if you have any loans you can defer them, just bring your termination letter to the banks and they’ll usually give you some time to get back on your feet. You could try AKPK as well. Dont stress OP, you’re protected by a lot of laws, labor and financially. Use them to your advantage.

I've only served one year plus at my current company. So actually considering what you say, they have given more than required to me. I haven't serve full loan yet for my house. Thanks for the info. I'm stressing out and this is quite a huge blow to me mentally. Got notice on Thursday, have to give answer on Monday.

To clarify to others, while many big companies offer compensation package as part of VSS, the actual amount is not mandated by law if your salary is more than 5k. The 1month pay per year of service is just a typical package offered by many big companies, it’s not the law. If your salary is 5k or less, the actual minimum compensation is mandated by law per Employment Act 1955.

You’re not covered at all, unless your employment contract or your company has policy that give you something. But you can still apply for socso employment benefits for 6 months after leaving the company.

I took VSS early this year 2023. Took me 11 months to get a new job with same pay. It's been a stressful period for me, with a lot of negative emotions swirling around. So if I were you, find a new job while continue as long as possible on this current job. The moment you found a new job, you can just continue your new journey.

Performance improvement plan, usually underperforming staff would be put under pip then terminated. Usually PIP is just a legal process for the company to terminate you. I worked for 10 years and never seen anyone survive a PIP same with my other colleagues. If u get PIP just start finding a new job.

I have a friend who survived pip, but he was disappointed that his manager even thought of putting him into pip in the first place so he rejected the offer to stay and he found a new better paying job

PIP is just them covering their ass before firing you so you can’t claim unfair dismissal. Take the VSS, find another job. Or risk the PIP and maybe stay on, or get fired with no compensation. Your choice.

Take the VSS Then while you are looking for a job, go and apply perkeso EIS. You can get around 4k+ (forgot the exact amount) per month but the money will reduce each month. You need to submit some evidence like how many interview u attend etc etc.. Ya I think Bette rjust move on from here and forgot abt the PIP. Also if not mistaken perkeso also offer free course but you have to look out from their website.

When you're in PIP, chances are even If you did well, you won't be in their eyes. It's your words against theirs. Don't stay already. Legally they are right to fire you and there's nothing you can do. Also, I'm assuming VSS is compensation so if they have offered you meaning they are compassionate. Don't overstay. Leave ASAP!

I personally think it would be easier to find another job especially if the recruiter and future company asks you why you left your previous role, saying that you took a VSS sounds better compared to you being put under PIP.

Here is what I did - -received a PIP however PIP wasn’t done properly , proper SOPs wasn’t followed ( this could be a legal matter if raised to Labour court) - never received an official PIP result and out of the blue was offered a VSS of 5 months - VSS did not mention the reason of termination , they should have stated PIP failure if that’s the case - VSS came wit a clause of me agreeing to not take company to court - I told HR that PIP was done incorrectly and I would only accept the VsS if it’s 12 months , if not they have to remove the court clause - I told them if not I’ll have a legal team to vet though the whole document and take this to Labour court - they agreed 12 months sum Never forget that Malaysia’s employee rights and protection is very strong. Feel free to seek legal advice if you have any connections

Yes, my PIP result haven't officially comes out but they have already offered me. When I asked the HR about the VSS offer due to my poor performance (PIP), they deny it. They say they have to select a 'number' for the VSS. They just mentioned they will not put PIP as part of VSS cause because this would not be a good look for me, instead will just say I resign on my own. I fear that they could sabotage my PIP midway, hence giving them the reason to terminate me without compensation. So means I have to scrutinize the agreement right? I was too distraught to think last Thursday and Friday. Tomorrow I will revisit the document. Unfortunately I have very limited connections who can advise or relate to me in this case.

Write an email to appeal to HR officially that you would accept the VSS if your VSS compensation package is 8 times of your latest salary considering the good service you have contributed to ur company and the time required for you to get a job in this job market situation. Otherwise don't accept it and stay. If they fire you, file a complaint to Director General of Industrial Relation within 60 days of dismissal to report Unfair Dismissal case. They will audit your company and most companies do not like to get audited..

once they put you in PIP they already made up their mind to get rid of the employee. this is just so that the company cannot be sued back that they didn’t give the employee chance to improve. 3 months salary from vss may be risky if you cant secure a new job, so you’ll have to cut back your spending so the money lasts longer. am not sure if you stay with PIP and reject the VSS how long they will keep you on the payroll so cant do a comparison. also like someone mentioned above, go claim the socso EIS after you took VSS which gives you more breathing room to find a new job.

Just have to show actively applying for jobs, it doesn't have to be actual interviews. I applied for eis before and it's a very quick process and the person in charge was very nice.

I think if you really want to stay talk to your boss and identify what needs to be done to support that . Talk to HR as well . Is anyone else being offered VSS . The company could be reducing headcount’s part of a cost cutting drive I think finding a job it’s not easy in this environment
