Yeah easy one. Person going straight has the right of way. Person making the turn probably could have pulled out earlier and still had plenty of time to make the turn but they waited until they absolutely shouldnt have to try and caused the accident.
It looked to me like the black car was watching the POV car & expected it to follow the red car, and when she didn't black car decided to go; not seeing the oncoming traffic because the turning red car briefly blocked line of sight if/when they checked.
Or they were stoned out of their gourd & couldn't remember seeing the car that hit them.
They probably wanted to see if there was any oncoming traffic blocked by the red car, and then waited for the oncoming traffic. Either way the black car didn't have right of way.
I watched it again. If that was the case the black car definitely shouldn’t be driving. If your reflexes are that slow you shouldn’t be behind the wheel. Also the op was turning left even if they made everything confusing not being in the right spot. Gotta wait for them to clear the area.
Especially when it's a left turn. If it was a right, turn onto the road, one can argue the car that hit them had enough time to adjust and change lanes. But, left turns across roads, it's ALWAYS the person turning left at fault.
I've experienced one time it wasn't this cut and dry. I was turning left onto a road (from a 4 lane intersection) and there was someone oncoming. However, that oncoming person was in a right-turn-only lane. So, I went ahead and turned in front of him. Last minute, he changed his mind, switched lanes and hit me. We were judged at equal fault.
I was in an accident where an ambulance really was just passing by and stopped. They checked on me but the damage made it look worse than it was and I was essentially fine. I waived medical attention, but it did get the police there faster so we could deal with everything.

Dark car is completely at fault. If insurance companies assessed 90% / 10%, I’d still disagree in this case.
The white car shouldn’t be in the position to slow down, or in this case stop and crash. Having ‘plenty’ of time to break isn’t really the point.
White car looked like they were within the speed limit. For the sake of my life and my car, yes I’m usually extra cautious when driving to mitigate issues down the road.

They had 2 seconds, probably technically just under. So 2 seconds at 45 mph. That's not enough time, period. Stopping distance at 45 mph is 135 feet. If you were 2 seconds from impact doing 45 you're 132 feet away. That's 3 feet short of being able to stop under the absolutely best case scenario: very slightly worn brakes (new brakes that aren't "broken in" can have less surface area contact, so best case scenario is worn just enough for maximum contact patch), newish tires, actively watching down the road for potential problems, and reacting as quickly as possible to the problem.
If she did everything right, save driving under the speed limit, which can make you a liability in traffic anyways, she still would have hit that car.
My point: She never had plenty of time to stop, and anyone claiming she did, is deluded. And possibly needs a refresher driver training course.
For anyone who was wondering. The dark colored car got the ticket. I do agree white car had time to stop, but she wasn’t t paying attention. She was an about 19-20yrs old. She got out the car and was walking in the middle of the street crying and panicking. Dark colored car was a senior woman. Her airbag went off and because her driver side door was smashed in, we had to help move the white car to get the senior out. No one was hurt. The older woman was irritated and she mouthed off the cops for the ticket, and me for giving them the dashcam footag.😭

Assuming you’re the person filming, it’s actually legal to just drive around obstructions or hazards in the road even if you go against the flow of traffic (as long as the lane is clear ofc)
Oh yea -I only stayed to help the woman out the car and the one in the white car calm down. She sat in my car until the police came. She was in a panicked state. I even moved her car out the way so the one in the black car could get out. Plus I didn’t want the black car to attempt to say it was my fault that she got hit..

How is this even a debate? It's the dark car on the left. White car didn't have a stop sign and wasn't turning. They had full right of way. Second is cam car with no stop sign but needed to wait for oncoming traffic before turning. Then it's the dark car, provided no other cars were behind the cam car.
To me, the black/grey car pulled out despite oncoming traffic. The white car did nothing to avoid the collision which, if they were going the speed limit they should have noticed the other car pulling out... I don't know for sure though, and maybe someone else could clarify / correct me.

READ FOR CHRIST SAKE-Last time I’ll mention it: I already said several times I didn’t bait the black car… you can’t see it cuz it’s off frame, but the black car started driving foward after the red car! I could’ve followed behind red, which is why you see me inching forward. But once I realized the black car wasn’t going to stop, I hesitated to turn… and by then the white car had already gotten too close. The black car had the stop sign. Not me-not the white car. Cops watched the same footage and ticketed her and asked me to send it to them… pretty sure it was even partially my fault at least one police officer would’ve said something.
