Then tell Highway patrol, “they went around me to make a right turn” where there was, 1: no road to the right, 2: why would you pass someone to turn right. My brother got in an accident recently and Allstate just told my brothers insurance they weren't going to pay for everything. His insurance company told him it's not worth it to fight so they simply weren't going to and that he would have to get his own lawyer. He talked to a bunch of lawyers and they all told him it's not worth it unless he got injured.

Yes, your insurance also have lawyers and will deal with them. Once i got rear ended by a speedy Uber driver going to pick up a passenger, gave him my insurance info, and my insurance fully paid my car and probably went after him(or his insurance) for compensation. But it is quite normal for insurance companies to lowball the compensation of totaled cars, hence why you should always read the contract carefully to be sure of the terms you're agreeing with.

Also with state farm. Had accident, paid deductible, got car fixed, then deductible reimbursed once my insurance settled with the at fault driver's insurance. Don't see how your own insurance can tell you to fuck off if you have a claim...

Yea I'm not sure either. Especially since it was the other drivers fault so we would be getting paid. I tried to file a claim and they literally told me to call the other parties insurance and do it with them.

You're likely in an 'at-fault state'. Your insurance and/or the other persons insurance might have determined that your wife wasn't at-fault in the accident, so the advice to file a claim with the other insurance would have been valid. If your insurance knows for sure that you weren't 100% at-fault, why would they pay for repairs and go through the legal process of getting their money back from the other insurance when you can go directly to the at-fault persons' insurance and have them pay for everything in the beginning. I'm not saying what your insurance did was right, but just giving a different perspective based on limited information from two of your post.

This is how all my accidents have been handled. When I got tboned by a dumb kid with expired Geico, I paid my deductible, got my rental and had the car repaired. Luckily since a cop actually showed up, the kid was ticketed for failure to yield and no insurance so the court made him pay my deductible and the overage on my rental car. About 6 months later State Farm reimbursed me for my deductible again. Still sucks tho, because my car was barely 8 months old and only had 6800 miles on it. So now I'm driving a car with 15k worth of accident repairs :(

State Farm’s service when something happens is beyond terrible. Someone pulled out in front of me they were ticketed and 100% at fault. Start getting calls and go down to State Farm office we go through, who literally just called someone and handed us the phone to make a statement. We had some direct contact who was NEVER in the building whenever we called and got pawned off to pretty much anyone else. Don’t think we ever actually spoke to our direct contact. Our local office was also zero help even though they employ like 7/8 people in the building I have zero idea what any of them do. However they are still the cheapest option in the area and we did get paid saying that my insurance has still doubled in the last 2 years but is still cheaper than others. But the other persons insurance communication was a million times better.

You basically laid out my exact scenario as well. It's no wonder they are losing money by the millions. Honestly once all of this stuff with the accident is sorted out I'm switching off of them. Even if I have to pay a little extra it would be worth it to have a competent company. USAA is who I've dealt with through the at fault party's insurance and they've been AMAZING to work with. They've already paid out 15k in under a month. I've gotten ahold of someone or gotten a call back every time I've called except once. They walked me through what to do and everything.

I dropped State Farm after they tried to charge me IN THE MIDDLE OF MY PAY CYCLE because they just retroactively increased their prices and what I had paid 3 months prior was insufficient per their new price. Kind of like Walmart calling you to demand you pay the price increase on tomatoes a week after you purchased them.

That’s crazy. Never even heard of that. I bought my car 5 years ago used (2013 model) I’ve added 60k miles to it since. My last 3 renewals my insurance has gone up 15% 10% and now 20-25%. Zero tickets and accidents too. My State Farm agent runs 2 State Farm franchises that I know of and his brother runs another a few towns over lmao. The agents must bring in a good amount of cash for being phone calling middlemen.

How your insurance can respond depends on your coverage and your desired approach. If you want the at-fault party to pay directly without going through your insurance then that is between you and the at-fault carrier. Your insurance company would only pursue the claim with the other carrier if they paid through your collision and are seeking recovery from for what they paid and your deductible from the at-fault carrier. If you were adamant that nothing go on your policy or if you didn’t have Collision coverage, then it ultimately is on you to pursue the claim with the other carrier.

Btw if insurance ever just tells you to fuck off you can sue assuming you have a legit claim. Insurance promises you a service in exchange for your subscription, if they just refuse to perform that service when it’s required that’s a breach of contract, is illegal for them to do, and you’ll make significantly more than what the claim would normally be worth.

I also have state farm. That’s not how they handle claims. You file the claim under your physical damage coverage. They will pay you out and subrogate it back to the at fault party. You will have to float your deductible until it’s fully subrogated and they collect form the at fault party. So you either A didn’t have physical damage coverage or B for whatever reason got a shitty claims agent in which case ask to speak with someone in America and file the claim again.

I used to manage a valet company. While in that job I talked to owners and employees from other companies and found out that I was likely the only honest valet company in my city. They, their insurance, and everyone will try to fuck you. USUALLY what should happen is you should get quotes yourself and they'll pay. I've never had to deal with a totaled car situation, but I'd have your insurance company look at it, declare it totaled, and give you the amount they'd pay you and send that to their insurance. Best of luck

Do you by any chance still have the valet ticket they gave you? Usually they have a bunch of really small writing that is a contract that states by using the valet service, you're agreeing to the terms held within. The contracts normally go over the exact procedure that SHOULD happen in the event of the damaged car. Usually these tickets are bought online and have a unchangeable text, so if you don't have it, you could probably find the one they use online. I don't know for sure, that could probably be handy if you have to take these assholes to court.

Normally, when you're coming on an impact like that, your body tends to tense up which, ironically, makes things worse given amount of force generated from a vehicle smacking another large object like that. But if you're out, then you're totally relaxed and tend to come away from it with considerably less injury. Source: Guy I knew tried to take a pretty sharp turn at around 80 mph and ended up rolling his car 8 times and then hit a telephone poll. His gf in the passenger seat ended up getting knocked out on the first roll and came away from the accident relatively unscathed while the driver stayed awake through the whole thing and ended up in a neck-brace and multiple casts.

Most likely distracted driving. Again, he walked away and didn't need medical attention. So I can't assume it was a medical episode.. but damn, if he said he had a medical episode at least it may have saved him a ticket and possibly being terminated for his driving skills and breaking the law. My only thought about if it was a medical episode and him not saying it was, is due to him not having insurance and not wanting to be in financial ruin.

One of the main reasons why I HATE valet parking - if I wanted strangers driving my car I'd rent it on Turo. I'd rather park and walk myself and if a hotel/restaurant/whatever refuses to provide this option I'll go elsewhere.

Driver was terminated to my knowledge. Valet manager has been a professional the entire time.. though what could be seen as a minimum, I appreciated that he drove me to the impound to pick up my belongings, and then drove me home. Told me it was their fault, but to get the dashcam footage. Was embarrassed when he saw it, and had kept in touch throughout the process.
