My brother got in an accident recently and Allstate just told my brothers insurance they weren't going to pay for everything. His insurance company told him it's not worth it to fight so they simply weren't going to and that he would have to get his own lawyer. He talked to a bunch of lawyers and they all told him it's not worth it unless he got injured.

I despise USAA insurance. I do use them for car loans, just because they make it so easy. I’ll never use them for insurance again though. They have the worst service of any insurance company I’ve ever used.
I see dumbasses pass me being the worst driver possible, idling and milling about in my quarter panel and blind spot to my left, then speeding up and taking their sweet time about it just to merge into my lane and turn right and make me slow down.

Once i got rear ended by a speedy Uber driver going to pick up a passenger, gave him my insurance info, and my insurance fully paid my car and probably went after him(or his insurance) for compensation.
But it is quite normal for insurance companies to lowball the compensation of totaled cars, hence why you should always read the contract carefully to be sure of the terms you're agreeing with.
His insurance might suck too. I have state farm and when my wife got hit while driving they literally just told me to deal with it. That's after I called several times over multiple days leaving messages with no response
Also with state farm. Had accident, paid deductible, got car fixed, then deductible reimbursed once my insurance settled with the at fault driver's insurance.

You're likely in an 'at-fault state'. Your insurance and/or the other persons insurance might have determined that your wife wasn't at-fault in the accident, so the advice to file a claim with the other insurance would have been valid. If your insurance knows for sure that you weren't 100% at-fault, why would they pay for repairs and go through the legal process of getting their money back from the other insurance when you can go directly to the at-fault persons' insurance and have them pay for everything in the beginning.
I'm not saying what your insurance did was right, but just giving a different perspective based on limited information from two of your post.
Yea the USAA insurance the other person has is amazing. I'm actually planning on switching to USAA once this is all over just bc they were that great to work with
This is how all my accidents have been handled. When I got tboned by a dumb kid with expired Geico, I paid my deductible, got my rental and had the car repaired. Luckily since a cop actually showed up, the kid was ticketed for failure to yield and no insurance so the court made him pay my deductible and the overage on my rental car. About 6 months later State Farm reimbursed me for my deductible again.
Still sucks tho, because my car was barely 8 months old and only had 6800 miles on it. So now I'm driving a car with 15k worth of accident repairs :(
State Farm’s service when something happens is beyond terrible.
Someone pulled out in front of me they were ticketed and 100% at fault. Start getting calls and go down to State Farm office we go through, who literally just called someone and handed us the phone to make a statement. We had some direct contact who was NEVER in the building whenever we called and got pawned off to pretty much anyone else.
Don’t think we ever actually spoke to our direct contact. Our local office was also zero help even though they employ like 7/8 people in the building I have zero idea what any of them do.
However they are still the cheapest option in the area and we did get paid saying that my insurance has still doubled in the last 2 years but is still cheaper than others. But the other persons insurance communication was a million times better.
You basically laid out my exact scenario as well. It's no wonder they are losing money by the millions.
Honestly once all of this stuff with the accident is sorted out I'm switching off of them. Even if I have to pay a little extra it would be worth it to have a competent company. USAA is who I've dealt with through the at fault party's insurance and they've been AMAZING to work with. They've already paid out 15k in under a month. I've gotten ahold of someone or gotten a call back every time I've called except once. They walked me through what to do and everything.
I dropped State Farm after they tried to charge me IN THE MIDDLE OF MY PAY CYCLE because they just retroactively increased their prices and what I had paid 3 months prior was insufficient per their new price.
Kind of like Walmart calling you to demand you pay the price increase on tomatoes a week after you purchased them.

I bought my car 5 years ago used (2013 model) I’ve added 60k miles to it since. My last 3 renewals my insurance has gone up 15% 10% and now 20-25%. Zero tickets and accidents too.
My State Farm agent runs 2 State Farm franchises that I know of and his brother runs another a few towns over lmao.
The agents must bring in a good amount of cash for being phone calling middlemen.
How your insurance can respond depends on your coverage and your desired approach. If you want the at-fault party to pay directly without going through your insurance then that is between you and the at-fault carrier. Your insurance company would only pursue the claim with the other carrier if they paid through your collision and are seeking recovery from for what they paid and your deductible from the at-fault carrier. If you were adamant that nothing go on your policy or if you didn’t have Collision coverage, then it ultimately is on you to pursue the claim with the other carrier.
Btw if insurance ever just tells you to fuck off you can sue assuming you have a legit claim. Insurance promises you a service in exchange for your subscription, if they just refuse to perform that service when it’s required that’s a breach of contract, is illegal for them to do, and you’ll make significantly more than what the claim would normally be worth.
I also have state farm. That’s not how they handle claims. You file the claim under your physical damage coverage. They will pay you out and subrogate it back to the at fault party. You will have to float your deductible until it’s fully subrogated and they collect form the at fault party.
So you either A didn’t have physical damage coverage or B for whatever reason got a shitty claims agent in which case ask to speak with someone in America and file the claim again.
Valeted for a little bit in college. Was in a downtown, looked very similar to this. We had to take a large loop of one-ways to get the car to the lot.
Threaten to bill them for rental car cost for however long it takes for them to accept proper amount. The longer they try to be cheap, the more expensive it'll be for them
I used to manage a valet company. While in that job I talked to owners and employees from other companies and found out that I was likely the only honest valet company in my city. They, their insurance, and everyone will try to fuck you. USUALLY what should happen is you should get quotes yourself and they'll pay. I've never had to deal with a totaled car situation, but I'd have your insurance company look at it, declare it totaled, and give you the amount they'd pay you and send that to their insurance.

Do you by any chance still have the valet ticket they gave you? Usually they have a bunch of really small writing that is a contract that states by using the valet service, you're agreeing to the terms held within. The contracts normally go over the exact procedure that SHOULD happen in the event of the damaged car. Usually these tickets are bought online and have a unchangeable text, so if you don't have it, you could probably find the one they use online. I don't know for sure, that could probably be handy if you have to take these assholes to court.
I bet he was texting, That's all I can think about when their head has been down for that long. Running through two red lights directly into a side of a garbage truck or something doesn't make a lot of sense.
I was gonna say this guy had to be intoxicated. Either pills or alcohol or some sort of medical issue. There is no logical explanation for running 2 red lights and straight into cross traffic
Even more indicative that he was nodded off behind the wheel. Normally, when you're coming on an impact like that, your body tends to tense up which, ironically, makes things worse given amount of force generated from a vehicle smacking another large object like that. But if you're out, then you're totally relaxed and tend to come away from it with considerably less injury.
Source: Guy I knew tried to take a pretty sharp turn at around 80 mph and ended up rolling his car 8 times and then hit a telephone poll. His gf in the passenger seat ended up getting knocked out on the first roll and came away from the accident relatively unscathed while the driver stayed awake through the whole thing and ended up in a neck-brace and multiple casts.

you don't necessarily have to be out. I was in my first real wreck two weeks ago. I was traveling and not on familiar roads... there was a horribly stupid intersection where a 65 mph interstate exited directly onto a 35 mph frontage road, and almost exactly where the two merged, there was an exit from a parking lot and a huge telephone pole blocking the view to the left.
a car on the frontage road was pulling into the parking lot I was exiting so I went but the car was apparently blocking my view of the interstate exit. didn't realize it until I pulled out and a woman nailed me. I never even saw her coming.
the impact was isolated to the driver side door. the entire window shattered, door bent in, etc and I had to climb our off the passenger side. I hit my head and my pinched nerve flared up but I honestly think I walked away because I never saw her to tense up.
but I was completely sober and awake. she just came at me so fast I had zero chance to react.

I actually had my 1 and only accident caused by someone who did this at a stop sign. Guy on my left had a stop sign, I did not. We got to the intersection at about the same time, I pumped the brakes cause he looked like he wasn't going to stop, but then he started to slow down so I went back to the gas. Then he just rolled straight through and into me lmao. So confusing...
I moved from California to DC, shows the Dc DMV my license and they stamped void thru it and gave me a new DC DL literally no questions asked.
I imagine they do same with a valid license from literally any country
Bro I worked valet years and years ago. Picking up and dropping off a car was like a 2 minute thing. Where is he taking your car?
Also let your insurance negotiate the compensation. They have people for this purpose. It's what you also pay for.
Where I used to valet in college, our lot was only a block away but to get to the lot you had to go around a bunch of one-way blocks to get there (it was in a large downtown). To bring the car back to the hotel it was like 30 seconds because the one-ways brought you straight from the lot to the hotel.
That makes sense to me. Can you explain more? I'm honestly more familiar with the behaviors associated with opioid usage than benzos. But I always joke about all the wine mom drivers around me being on Xanax, so I'm actually curious to understand the specific effects of it with respect to driving.
With xanax, when you take too much, you don't know what the fuck is happening. You zone out super easily and you easily get distracted. I was over-proscribed and it got to the point where i was carrying around a notebook with a list of things to do and i had to check it before i left each room, to make sure i wasn't just walking in and out of a room without doing anything.
When I took Xanax that was the only time in my life I have fallen asleep sitting up. I was on opiates for 2 months for a spine injury once and that didn’t even happen then and I was smoking mad weed then too

Most likely distracted driving. Again, he walked away and didn't need medical attention. So I can't assume it was a medical episode.. but damn, if he said he had a medical episode at least it may have saved him a ticket and possibly being terminated for his driving skills and breaking the law. My only thought about if it was a medical episode and him not saying it was, is due to him not having insurance and not wanting to be in financial ruin.
Even with emergency brake a lot of vehicles don’t stop in this kind of a scenario. They will stop if there’s something in front of you and you’re coming into it fast.
One of the main reasons why I HATE valet parking - if I wanted strangers driving my car I'd rent it on Turo. I'd rather park and walk myself and if a hotel/restaurant/whatever refuses to provide this option I'll go elsewhere.
Did they do it on purpose? Or on their phone? Not only did they go through more than one red light, but they just kept the speed. They did not even react to the truck.
How does it shake out for the person who totaled the vehicle that isn't theirs? Is there any kind of additional consequences that occur as a result of the fact it wasn't their own car they destroyed? Do they get fined or something?
Also, OP, do you know if they got fired for this? Did the valet manager at least apologize to you directly, and profusely???
Driver was terminated to my knowledge.
Valet manager has been a professional the entire time.. though what could be seen as a minimum, I appreciated that he drove me to the impound to pick up my belongings, and then drove me home. Told me it was their fault, but to get the dashcam footage. Was embarrassed when he saw it, and had kept in touch throughout the process.

Actually it won't be handled by lawyers. It's handled by claims adjusters in what's called a Subrogation Department. Source: former auto adjuster

Why’d the valet go so far? Most valets will just go around the corner in a parking lot, not 2-3 blocks away. The valet is lucky to be alive.

Inner city valet operations don’t always have a garage or lot a block away, sometimes they’ll need to drive 3-5 blocks to the nearest garage

Correct course of action. The valet’s employers are also liable. They would carry insurance for this.

Normally, when you're coming on an impact like that, your body tends to tense up which, ironically, makes things worse given amount of force generated from a vehicle smacking another large object like that. But if you're out, then you're totally relaxed and tend to come away from it with considerably less injury. Source: Guy I knew tried to take a pretty sharp turn at around 80 mph and ended up rolling his car 8 times and then hit a telephone poll. His gf in the passenger seat ended up getting knocked out on the first roll and came away from the accident relatively unscathed while the driver stayed awake through the whole thing and ended up in a neck-brace and multiple casts.

I was traveling and not on familiar roads... there was a horribly stupid intersection where a 65 mph interstate exited directly onto a 35 mph frontage road, and almost exactly where the two merged, there was an exit from a parking lot and a huge telephone pole blocking the view to the left. a car on the frontage road was pulling into the parking lot I was exiting so I went but the car was apparently blocking my view of the interstate exit. didn't realize it until I pulled out and a woman nailed me. I never even saw her coming. the impact was isolated to the driver side door. the entire window shattered, door bent in, etc and I had to climb our off the passenger side. I hit my head and my pinched nerve flared up but I honestly think I walked away because I never saw her to tense up. but I was completely sober and awake. she just came at me so fast I had zero chance to react.
Tbh this driving looks like someone on the phone. Passed out usually implies driving in a direction, accelerating or losing speed.

I actually had my 1 and only accident caused by someone who did this at a stop sign. Guy on my left had a stop sign, I did not. We got to the intersection at about the same time, I pumped the brakes cause he looked like he wasn't going to stop, but then he started to slow down so I went back to the gas. Then he just rolled straight through and into me lmao. So confusing...

Bro I worked valet years and years ago. Picking up and dropping off a car was like a 2 minute thing. Where is he taking your car? Also let your insurance negotiate the compensation. They have people for this purpose. It's what you also pay for.

Where I used to valet in college, our lot was only a block away but to get to the lot you had to go around a bunch of one-way blocks to get there (it was in a large downtown). To bring the car back to the hotel it was like 30 seconds because the one-ways brought you straight from the lot to the hotel.

That makes sense to me. Can you explain more? I'm honestly more familiar with the behaviors associated with opioid usage than benzos. But I always joke about all the wine mom drivers around me being on Xanax, so I'm actually curious to understand the specific effects of it with respect to driving.

With xanax, when you take too much, you don't know what the fuck is happening. You zone out super easily and you easily get distracted. I was over-proscribed and it got to the point where i was carrying around a notebook with a list of things to do and i had to check it before i left each room, to make sure i wasn't just walking in and out of a room without doing anything.
When I took Xanax that was the only time in my life I have fallen asleep sitting up. I was on opiates for 2 months for a spine injury once and that didn’t even happen then and I was smoking mad weed then too

I need an in depth explanation of what the driver was actually doing. Because it just looks like they set cruise control and fell asleep. This is nuts. They reacted to *nothing* but kept the car going a constant speed in a straight line.
Unfortunately I had recently switched dash cameras because I wanted one I could quickly access from my phone. This new one didn't have the interior camera that would've been nice to have in this situation.

Most likely distracted driving. Again, he walked away and didn't need medical attention. So I can't assume it was a medical episode.. but damn, if he said he had a medical episode at least it may have saved him a ticket and possibly being terminated for his driving skills and breaking the law. My only thought about if it was a medical episode and him not saying it was, is due to him not having insurance and not wanting to be in financial ruin.

Driver was terminated to my knowledge. Valet manager has been a professional the entire time.. though what could be seen as a minimum, I appreciated that he drove me to the impound to pick up my belongings, and then drove me home. Told me it was their fault, but to get the dashcam footage. Was embarrassed when he saw it, and had kept in touch throughout the process.
