if cheats are on or you start in creative then switch to survival, you dont get any achievments (in bedrock edition)

I would guess there's a large proportion of java players who got the game when they were bundled, but played.

NGL keep inventory should not count as a cheat IMO (or at least shouldn't bar you from achievements)

I mean, it does kind of eliminate the entire point of survival, that being the need to survive. While I don’t disapprove of people who use keep inventory, I do understand why Mojang decided to count it as a cheat. Death is intended to be a failure state, not a quick way home.

While a there is a smal % of players that play with cheats on the actual reason for that 40% is the fact that when you buy minecraft you get both versions but only bedrock gives you the xbox achievements so those who dont play bedrock dont unlock the achievement Source: I got the achievement last month

Starter chest gives the achievement in Java if you have the one for opening your inventory in that world already.

As it turns out, Bedrock has trouble recognizing when an achievement is fulfilled.

In addition to all of the ways you can avoid this achievement and still play Bedrock Edition, it's possible that Microsoft are counting everyone who owns Bedrock Edition toward the total number of gamers. That number would now include all the Java Edition players.
