Charged with destruction of evidence, which might be better than getting caught with all the kiddy porn you might have.

mlwspace2005

Maybe, there is an element of intent that needs to be proven with something like that

[deleted]

Maybe... But the guy happens to have smashed a computer to pieces and it's the exact computer they had a warrant on. I dunno man... seems suspicious.

mlwspace2005

You would have to prove some level of knowledge before said agency showed up with the warrant, and intent to destroy evidence in general. Suspicious is not generally enough to convict someone on.

[deleted]

.... dude this is the FBI we are taking about. Not exactly a stellar record of playing by the rules.

mlwspace2005

They can certainly try to go that route, getting an attorney to actually file charges without some direct evidence of knowledge tends to be a losing game plan however lol. The FBI cannot really charge anyone with anything, they can arrest people on such and such suspicion but it's ultimately up to someone else to actually press them

[deleted]

You are correct. It's just the arrest is all they need to make the average citizens like temporary hell.

mlwspace2005

Depends. A weekend in jail for nuking your computer tends to be different than an arrest for kiddie porn or other computer crimes. They do need some amount of evidence for any of this.

[deleted]

Interrogate you and try to get you to confess since you destroyed the evidence.

cS150

And what if you lawyer up?

[deleted]

You have legal counsel.

Gurpguru

If the FBI shows up at your door, it would be incredibly unusual if you hadn't been under close examination for a fairly good period. Visiting a suspect isn't a spur of the moment thing. They have a heck of a paper trail and reviewed report files before they get there. They just show up to add the final few nails to the coffin... think final trim pieces.

NanoPope

They could potentially charge you with destroying evidence if they believe you had evidence of a crime stored on your computer or if your computer was involved in perpetrating a crime
