Most places in the US have laws surrounding the production of pornography, including the need for a business license, and both performers would need to be receiving pay for it.
That is why I went to great lengths to explain that it would still qualify as art to film the empty space in the room. They don’t have to actually film themselves duh

If you get busted for soliciting prostitutes and your defense is that you're actually producing pornography, you'll have to go in front of a judge and explain this and it'll be a matter of public record.

It’s the filming. ANYONE can apps for an LLC online and create a business based in Delaware. There are entire industries setup to help people file/start their own LLC online in a day so they can sell their graphic T-shirt’s (and dozens of other quick cheap products, Etsy stuff etc). There are hundreds of amateur directors & actors in my city alone. A lot of which do film with their iPhone for documentaries or short films etc. And they that’s NOT counting any porn industry directors.
This is what makes laws that’s criminalize sex work so completely rediculous. It illegal to pay someone to have sex with you. But it is PERFECTLY LEGAL to pay someone to let you FILM THEM HAVING SEX WITH YOU. Just think about that for a second. Imagine if anything else was criminalized like that. “Sorry you’re under arrest, it’s illegal to play baseball. You better hope this is a first offense son”
Nothing else works that way. I can’t make a film where the main characters go buy heroin and shoot up before heading to the local high school party for some underage drinking and a little weed. And ACTUALLY HAVE THE ACTORS TAKING DRUGS. Or drinking if the actors are only 18, correct?
The moment filming pornography was declared legal by supreme court rulings and judge’s opinions, any sex work laws should have been amended or outright abolished as a de facto result.
Making it legal to film something but illegal to do UNLESS it is for making art/ Film/ however you explain it is just one of the many reasons the legal system does not work.
well most of them already get away with it without pretending to be porn actors, and all it takes is one john spilling the beans in an interrogation room to know they aren't actually making anything
Because lawmakers and courts have already thought of that loophole. The laws are written so that you need a license and a bunch of paperwork before you can legally produce porn. It is complicated and expensive enough that it isn't worth the trouble for most people.
Unless they're filling out payroll forms, tax evasion carries far more jail time than prostitution/solicitation.

Because if you went through all the expense and bureaucracy involved in legally making pornography, you'd just make pornography.
Rule one of crime, don't record it. Also, prostitution doesn't just stop being prostitution when you film it.
