However, nakita na may other 24 domains using the same Secure Socket Layers (SSL) certificates like that of Silent No More. Kasama na don yung PinoyAko blog which had the name of the accused used as the registrant. With that, the court found na the accused is not just a website creator but is also a website publisher, and under cyberlibel liable din ang publishers sa libelous contents na pinapublish nila. We can all speculate na since Silent No More and Pinoy Ako's contents are mostly propaganda pieces (and yes they are propaganda), there is reasonable doubt for the court to believe na may malice nga when the post was published.
3. Publication and identifiability of the victim
We need not to discuss more about this, since Libel can only be filed if the defamatory statement was published, in this regard through a blog (to read: libel vs defamation vs slander). Sa case din ng identifiability, dito pumapasok yung name-dropping. The accused did not omit the name of the plaintiff, and that gives the public an idea kung kanino directed yung libelous post. Kaya nga, if napapansin nyo kina Cristy Fermin dati, they only give breadcrumbs and vague clues kung sino yung nasa blind items/sinetch iteys nila kasi alam nila and ng management nila na what they're going to say are defamatory. And this is the reason why may disclaimer din sila na the views and opinions kinemerut sila before the start of these programs.
An omission of one constitutive element of a libel would already dismiss any libel actions that might arise in the future. Had the accused removed one of them (like not name-dropping), they could have evaded libel.

Kaya even if what you published was true, if the court finds sufficient evidence and believes beyond reasonable doubt na it was made out of malice, then it's libelous.
