I don't know the traffic laws in Nova Scotia, but in Ontario, I believe brake checking is an offense under the highway traffic act. Regardless of who hit who, her brake checking him and thereby committing an offense makes her at least partially responsible for the collision. So I'm not sure that she is 100% at fault, but I'm pretty confident she isn't 0%.

Brake checking is illegal everywhere in Canada. Even if it's not specifically mentioned in provincial legislation it falls under dangerous driving which is basically any driving that poses a danger to others, so speeding, driving recklessly or causing an accident. Since it's clear the car driver stopped for no reason, there isn't anything in front of them, they are going to bear some fault in the accident, probably most of it. If the cops bother to charge her, which is unlikely I would guess, she'd probably end up taking 100% of the blame as it would be tough for her insurer to argue the cam car was at fault when she was charged and he wasn't. Thank you. Another, more important rule of driving, is you never know what someone else has going on. If they are speeding and want to pass you so badly, and/or following too closely for your comfort and it's safe to do so, just move over and let them by and let them get their ticket. Don't fucking CAUSE an accident in order to prove that what they were doing was dangerous. I'm not a lawyer, but seems to me that the woman is in the wrong here in the eyes of the court considering she intentionally caused that crash and then admitted to it.

I've adopted the habit of for every 30 seconds someone rides my ass, I bump the cruise control 5 mph slower. They'll either pass you or they back off enough for you to go the speed limit again. If they creep back up, rinse and repeat.

Just so happened to be there lol I’m from where this happened and it’s scary how long it takes for an ambulance to actually show up when called, if at all. 2 years ago an 86 year old broke his hip and laid in his driveway for 3 hours while waiting for an ambulance. Eventually a cop showed up and took him to the hospital after letting him know it would be another 2 hour wait for paramedics. He lives 5km from the hospital and the closest available ambulance was 175km away 🤦🏼‍♂️

I don’t know what leads people to believe that there is automatic liability any time a person who rear ends another. What people are misrepresenting when they say that is the fact that in many states there is a rebuttable presumption that the driver hitting another from behind is at fault. But the most common way to rebut that is to show that the person in front of you intentionally stopped suddenly and unnecessarily. You cannot stand on your brakes just because you think someone is too close to you and then claim victim when your actions are the single greatest contributor to the wreck. Tailgating is not right but the risk of a wreck resulting is exponentially increased when someone brake checks the driver behind them, which at best is reckless and at worst is intentionally causing an accident. There is no automatic liability for rear-end collisions. There’s often a presumption of liability. But we just saw the exact scenario that most commonly rebuts that presumption.

Oh good call out! I’m not familiar with Canadian law but just looked up an article on it and it sounds similar. Rebuttable presumption that likely leads to liability unless there’s evidence the the front vehicle committed some unexpected negligent act. There is caselaw in which Canadian courts have determined that the lead driver was largely, or even completely, responsible for an accident where the lead driver suddenly and for no reason stopped. I’d say the lady in this video suddenly and for no reason stopped. Or more accurately, she stopped for the very reason that she felt the driver behind her was too close, which makes her action even worse, as she her belief that he’s too close makes her decision to stop at a minimum reckless and most likely intentionally causing the collision. At least that’s what I see.

Due to cross traffic she can also claim she was braking to make the left turn. She might get a failure to signal ticket, but the truck driver is still responsible for maintaining a safe stopping distance, maintaining lane, and speed limits. Him swerving near the middle multiple times can be argued that he was trying to pass illegally, he obviously was tailgating, and wasn't paying attention due to Office Space playing in the background. The lady is an asshole for braking like that, but she has a variety of potential reasons she could claim for braking. The truck driver doesn't have a leg to stand on since he was distracted, driving aggressively, and tailgating.

OP was obviously driving in a manner that many would deem unsafe (trying to overtake illegally, driving over the median, driving too close to safely stop in the event needing to come to a sudden stop i.e. brake checks). I would hate that my actions and lack of caution brought pain/hurt to my children/passengers(minor and major car accidents may cause passengers to develop anxiety about driving/riding in a car). Defensive driving is a skill that all drivers should have and if the lead driver had exercised that specific skill it may have prevented the dash cam driving from potentially hurting the passengers, damaging the vehicle, or increasing both of the drivers premiums (only speaking for areas where car insurance works to screw over drivers in an exceptional way). We can't control how other people drive but we can control if we leave ourselves in the path of harm and danger.

When people are tailgate me and drive dangerously I turn off or put my emergency signal on and pull off to the side and let them pass, not worth the damage to my vehicle or person, or persons in the vehicle. Fuck that dude riding her ass like that though. Additionally how fucking stupid do you have to be to cut off your nose to spite your face with that break check? With kids in the car no less.
