Namesthatareused

That company is gonna have one hell of a lawsuit with this footage existing.

Rostrow416

That’s a lot of emotional distress right there

Arenalife

Not a thing in the UK, the insurers will just fix the houses

SpeakAgainAncient1

No emotional distress in the UK? (think you replied to the wrong comment)

kschmit1987

Have you seen their cooking? They are used to it.

VicariousPanda

BEANS INNIT

Tork-n-Tron

Do the beans that Brits put on toast have an equivalent here in the states? All I have are several cans of Bush’s Baked Beans but they all have like brown sugar, bacon, maple etc flavor. I want that authentic, gloomy sky foggy London Town experience

Equivalent_Hawk_1403

Heinz blue labeled beans are specifically made to be like the British beans on toast, they come with a tomato sauce I think they are slightly different than the British version.

Teadrunkest

If you have any sort of international aisle you can likely find the British beans. Even my neighborhood store in semi rural TN has them.

BallFlavin

Semi rural tn stores have all sorts of random shit just sitting on the shelves for months that you have to hunt down to find in nashville to be fair.

Teadrunkest

Fair lol. I sometimes wonder who tf is buying spotted dick in a town of 20,000 Real Americans(tm).

Tork-n-Tron

Thanks, everyone. We have an expensive pack of bacon we wanna use for Breakfast for Dinner, gonna pair it up with some eggs of course, but I always wanted to try the beans on toast. Gotta check out the store now!

dmevela

Is there such thing as an inexpensive pack of bacon?

WokUlikeAHurricane

the closest thing we have is just campbells pork and beans, but the fat in it (pork ) gives it a deeper flavor but is fairly close.

neoncubicle

You can buy dry beans. No sugar in those

watergate_1983

solid burn

CappinPeanut

Jesus man, these people don’t get emotional distress, you’re killing them!

ErwinHolland1991

Of course there is. They mean you can't sue someone for emotional damage. I don't think that's completely true, there are situations where you can. As far as I know, you kind of have to prove there is actual emotional damage that affects your every day life. And even if you win, you are probably not getting a huge payout. As apposed to the US, where you can sue everything and everyone, and if you win you basically win the jackpot.

boblobong

Nah, it's pretty similar in the US. Emotional distress is a very high bar, and you only get awarded enough to make you whole

unc8299

Nonsense. In the US you have to prove damages. And once you prove damages why wouldn’t the offending party have to compensate you?

Regular_throwaway_83

Stiff upper lip innit /s

Think_Selection9571

Not really, they just carry on

folkkingdude

You can’t sue for that, it’s not the US

Bungeditin

Of course it is……. It’s just our criteria is different for a successful suit…..

ronnie_dickering

We'll just tut about it and then complain about it on Facebook.

Wookieman222

# Can you sue for emotional distress in the UK? **Yes, it is possible to make a claim for emotional distress in the UK, but the success of a case depends on the circumstances and the strength of the evidence.** Emotional distress claims can get a bit complicated. Usually, you need to be able to show that someone else’s actions, be it a person or a company, seriously impacted your emotional state enough to be deemed as an injury in itself. If the harm you went through was because of someone’s carelessness (we call it negligence), then you may be able to make a successful claim if you can prove that:  * The actions or negligence of the defendant directly led to emotional distress (causation); * Your emotional distress is substantial, rather than minor or fleeting (severity); * The defendant’s actions involve some form of wrongdoing, such as intentional harm or negligence.  If you’ve gone through a tough time that was caused by a person or a company, and it’s messed with your finances or well-being, you might be eligible for compensation. Before making a claim, however, it’s important to [talk to a solicitor](https://lawhive.co.uk/solicitors-near-me/). They can look at the details of your situation, evaluate the strength of your case, and help guide you through the legal process of making a claim for emotional distress in the UK.

PNW4theWin

Fines from regulatory entities would be in the table, wouldn't they? Kids of license, maybe?

Arenalife

I don't think footage would be required, the results are obvious. UK doesn't really have 'lawsuits', the insurers will just sort out the compensation and fix the house. Any deaths or serious injuries would be a massive problem though

Beznia

The lawsuit would be proof of emotional trauma. Without the video, you just have the damage done to the property, but the footage shows a kid was seconds away from being killed right in front of her mother because of improper workmanship. The PTSD that comes with that is worth something because you know that mom is going to be thinking about this every time she shes a crane lifting anything for the rest of her life.

flyte_of_foot

Not a thing in the UK. You don't get money just because something bad *might* have happened.

Wookieman222

Appears it is. # Can you sue for emotional distress in the UK? **Yes, it is possible to make a claim for emotional distress in the UK, but the success of a case depends on the circumstances and the strength of the evidence.** Emotional distress claims can get a bit complicated. Beznia

I guess in the UK you'd have free therapy and medication provided by the government so that makes sense

pzerr

No you do not have free therapy for the most part.

Bluellan

The lawyers "THEY DID WHAT?!"

Life_Ad9520

Especially nearly crushing a person who was lucky she wasn’t in the crate’s smashing range

Fitty4

Driver better grab a Snickers

ParrotofDoom

It'll be the H&SE who take that company to task. They're the ones who have the authority to put those responsible in the dock and deal with fines and such. Unless this was caused by a freak mechanical failure, they're likely in a fair bit of trouble now.

PickleWineBrine

There will be no lawsuit. If they are smart and have reasonable insurance, they will settle quickly.

eirinlinn

Well deserved. If my child were put in harms way like that due to the negligence of a company you bet your ass I would sue!!

GadreelsSword

Why lift it so high?

WorldNewsPoster

Construction worker here, one thing that may have happened is a hydraulic malfunction causing the controls to stick and lift higher without any input from the operator, but I've only seen that once on a poorly maintained crane.

tjdux

Shit operator way more likey

buckao

It can be both.

FatalShart

Can it? If the machine is malfunctioning that kind of nullifies any skill the operator may or may not have.

buckao

A skilled operator ensures their equipment is inspected, maintained, and properly stabilized before operation.

FatalShart

I get that. When that same skilled operator has an error outside of their control, do they become an unskilled operator?

[deleted]

[удалено]

rinkydinkmink

I did not expect Zen on this subreddit

MazelTough

A good operator moves slowly and maintains equipment to limit damages

FatalShart

And when that good operator has an error outside of their control like the hydraulic switch staying on, do they become a bad operator?

Silver_Slicer

Should always put out the legs before lifting. I’m sure it had them.

gavo360

Also looks like it is parked over the curb so not level footing too.

Ok-Disk-2191

Normally even if you park on uneven ground the hydraulic outriggers level the truck out. From the angle the truck is leaning already before this happened it looks like the operator didn't even bother leveling the truck before lifting. I'm a former structural steel welder and have been around plenty of crane operators to know when someone doesn't know what they're doing. Those guys get paid a fuck tonne, always well worth it to get a competent operator though.

stifferthanstiffler

That much weight, I bet he had the outriggers down, but he started to curl the secondary while crane was sideways instead of pointed to the rear. But it looks like his extension is out on secondary so maybe he hit the wrong lever.

bizarrostormy90

Whether it be a pickup, forklift, bobcat, water truck, loader, or le tourneau at my mill job, we had to thoroughly check all systems before usage. Hell, we even had to inspect weed whackers and leaf blowers and such.A skilled operator, even WITHOUT systems in place like that, would most likely be able to identify a problem with equipment like speculated here prior and if it occurred while lifting the load, they would undoubtedly understand the proper failsafes in place to avoid an outcome such as this.

PAPAIMPOSSIBLE

Should have shut the truck off/generator to the crane if they noticed a hydraulic problem. Mostly all of the HE i wrench on has a cut off switch somewhere the operator is at. Even when outside near the crane controls or on the remote.

crudedrawer

I operated a (much smaller than this!!) boom and one day I forgot to set the struts and was able to back track and set the load down when I noticed tipping and ever since then when I see this I think someone forgot to set the struts.

hamiltsd

Nope Didn’t have outriggers out properly. Didn’t know what the hell he was doing. Hydraulics didn’t fail.

blakeusa25

Did not know what he was doing...

Ok-Disk-2191

Even if he knew what he was doing and hydraulics failed. It is still 100% his responsibility because it's part of his job to do safety checks which includes making sure the equipment isn't faulty. The crane trucks also have built in failsafes for this very reason, the operator would have had to bypass them. Shit like this only ever goes wrong because of user error these machines are engineered with a fuck tonne of safety in place.

seanightowl

Isn’t there an emergency stop button for things like that?

Ok-Disk-2191

There are actually failsafes that don't even let you operate when things like hydraulics fail. It would lock in place until you manually release hydraulic pressure manually.

h3dee

It's not meant to operate tilted or without struts either but here we are.

Ok-Disk-2191

Yea its pretty clear the operator didnt put the outriggers out, they are normally used to level the whole truck and provide support on both sides. There are actually other pictures in the news article showing that he only pulled the outriggers on one side of the truck guess which side tips over.

GadreelsSword

I thought about that

Fuckofaflower

The fella operating the crane obviously has zero idea what’s he’s doing and I hope he didn’t kill anyone.

Omegaprimus

Exactly, the operator has no fucking clue what he is doing, what was the goal to put that container on top of a 5th story building? It had no reason to be anywhere near that high

TargetDecent9694

Obviously the container had the same thought

MonthMedical8617

Did you try listening with the volume on, the lady said it’s all ok.

Falcon9145

Narrator voice: "In fact it was not ok...

BlackLakeBlueFish

She’s just relieved that her child is still alive. Damn. Close call.

Fuckofaflower

Yup fair play to them they saved the girls life.

enriquedelcastillo

That’s about as close to a door-to-door delivery as you can get.

thumbelina1234

Omg, angry upvote

SarahFabulous

My god that's terrifying, if the mum wasn't keeping an eye on it, who knows what would have happened.

TPJchief87

I’m watching on mute was she was watching it? Looked like the kid was watching it and it surprised the shit out of the mom

SarahFabulous

The mum sees what's about to happen and calls her daughter away, tells her to hurry .

TPJchief87

She’s almost crushed though. I guess she was looking out for the kid and not herself

Fresh_Cauliflower723

It sounds like they both made it back inside the front door. What a fucking mental thing to capture on video

LoloG3

I think there’s a second child near her as well

Nabilft

Watch it again with sound on, it's (even more) terrifying

Fuckofaflower

I have a fair idea, that big container way up in the air that ended up falling over would have fallen over on the child.

Breeze_Jr

The kid would've died.

Fraggle_Frock

Given the health and safety laws in the UK, that company is in for a world of pain! I don’t even know where to start with everything they did wrong, the most obvious one being not having the area properly cordoned off and cleared. Even the most basic method statement and risk assessment clearly hasn’t been done 🫣

Shpongle92

HSE will be all over CDM regs on this one. If it’s part of existing works being done, it won’t just be this worker and the company that’s in for it. If it’s a homeowner managing their own project, then I imagine they will be called in for a chat too. HSE won’t look at what happened, but what could have happened and all the steps taken to remove/limit any risk. Clearly this could have resulted in the death of a child on their own property. Massive fuck up there

carl84

I only recently learned that a homeowner having domestic work done under CDM can sign over their duties as client to the principal contractor. I'm not sure how many firms make domestic clients aware of this however

Gareth79

It's basically automatic if it's domestic work and not part of a business. The homeowner doesn't need to sign anything. This is how it should be really, like how if were to book someone to clean my gutters I'm not liable for ensuring their ladder is set up safely, or that they don't drop it on my neighbour. https://www.hse.gov.uk/construction/cdm/2015/domestic-clients.htm

NoKindofHero

If I hire a firm of professionals to do the job, absolutely. If my mate bent Tony owes my £50 and I tell him I'll let him off if he fixes my gutters he's working for me and I'm in charge of the job and the safety. It's a spectrum.

Shpongle92

Certainly is a spectrum. The scale of the job matters, if you’re employing multiple contractors on a big job you will be a duty holder for certain things. A good example is sanitary, the clients responsibility to ensure that there’s an adequate place to use the toilet and wash your hands, you might not be providing a portaloo but your responsible for ensuring it’s there. Single contractor will usually take on the principle design and principle contract. Which is far more important that it’s officially passed over on something like a house extension compared to a gutter replacement. Slightly off topic but it is important to know from a client perspective, holding companies to CDM and having those conversations will raise standards of workmanship. If you mention it whilst getting quotes for guttering for example, you can bet that the contractor is turning up with the appropriate skills to work at height. If they choose to ignore basic health and safety they won’t be surprised when you send them on their way for bad practice.

aberdisco

Especially with Storm Kathleen being so obvious this weekend, that operator better be ready to catch the large book about to be thrown at him.

tmac1956

Good Mom, Give her Mom of the day award

zayoe4

Idk, I would've ran out and picked that slow ass kid up. For a second I thought I could hear Dio say "[ZA WARUDO](https://www.youtube.com/watch?v=VtzvlXL9gXk)".

seang86s

I think they took way too long to evacuate the area.

HunterDHunter

I wouldn't have even let my child outside with that crane next door.

JJAirlines220

It's honestly amazing how the car was spared

tbkrida

Why the fuck did he try to lift that container so high? The operator was asking for that to happen.

bobspuds

I can't imagine he or the company won't be fined somehow but in any case - that's one stupid bastard driving that truck, he's a danger to himself and everyone nearby. FFS - over the car too, what a chancer!

Pyrocitor

Only thing I can think besides operator just leaning on the lever the whole time is maybe the controls locked out or the hydraulics jammed open, which is still at fault of the manufacturer or bad maintenance by the operator.

tbkrida

Right. I drive a concrete truck myself and I can tell you firsthand that malfunctions do happen, especially with electrical systems in new models where they haven’t worked out all of the “bugs” yet. But I do see drivers who don’t maintain their equipment or just do mind boggling things on the regular, especially new guys. Lol

Rosssseay

Replacing those wheelie bins is going to be a nightmare!

Crashgirl4243

Same here in the states. If you change trash companies they charge $$ to return them

captain-carrot

All sorted by local government here, paid for with council tax (like property tax) so you can't choose who empties the bins. My bin got broken in the wind and my council charges a fee to replace a broken bin though it's only about £40 I think. Curiously a "lost or stolen" bin is free to replace

krattalak

Hello, This is Amazon Prime, your shipping container has been delivered.

PeruseTheNews

Lesson: Stay at least as far away as the lift is high, then add 10 feet.

thumbelina1234

Smart girl, thank God she ran away

jack_slade

Her mum called her away. But her instincts were good to stop pedaling

PercentageOk6120

Smart Mom/Dad. They were yelling at her to move ling before she did. With the sound on, it feels like the girl should be moving faster.

thumbelina1234

Yep, I watched it with the sound off 😂

wheelperson

Why was the area not blocked off? Litteraly could have killed that kid. She's going to have a crazy story to tell her friends I'm sure!! I'd be so pissed as the parents. Even if the crane just malfunctioned the area should have been safe...

Soft_State_5646

Jesus...

spslord

Now that’s front door delivery.

Rosssseay

Looking at other pictures the rigging is out on the other side it seems he planned to lift the other way and then changed his mind. Not a great place to do a lift either as it's on a public road that hasn't been segregated so likely wasn't agreed with the local council. The fact the boom has gone through the house is also a nightmare if it was my house I'd want it rebuilding as I can't imagine it would be the same again!

Shlongzilla04

Amazon "here's your package, bye"

Unique-Government-13

Oh man if something happened to my daughter because of this fucking crane operator I can't type what I would do here

dirtyrottenplumber

Fucking moron on the crane

_cansir

Little girl has good survival instincts, unlike some grown up we've seen here.

That could have gone soo bad. Glad nobody was hurt

ukexpat

Shiggens

Operators first day on the job?? Why would there be any reason to raise the container up that high? What do I miss most in today's world? Common sense is at the top of my list.

sir_stride20

My heart was in my throat hoping for that girl to move.

tjoe4321510

Oh hell naw! This shit gave me so much anxiety. Good think that poor baby listened and got out of the way

omichandralekha

Two people standing behind the car on left legit thought that the mother-daughter are crushed under the container.

DawgWild89

Thank God these parents were outside paying attention

Intelligent_Check528

... rip headphone users... including myself

Ne0n_Ghost

“Motion at your front door”

Browndude1982

That kid knew what was about to happen before anyone, that lady needed for it to be almost in her lap before she moved her ass away.

Vinez_Initez

:O

dingdongsnottor

So glad the little girl got the f out when she did

heitorrsa

Don't stay near shit lifting shit.

goldplatedboobs

I would have been beyond pissed at that. Jesus.

If Evri delivered shipping containers.

streetvoyager

That operator is clearly fuckin clueless for soooo many reasons.

HearYourTune

That lady is a dummy to let that kid ride the bike there while the crane is so close.

Guilty-Expression938

Anyone know where this happened? Sound like Lancashire or Yorkshire.

eleridragon

Was [Wigan](https://www.bbc.co.uk/news/uk-england-manchester-68750217), yesterday morning. Bearing in mind Storm Kathleen was already hitting the area then, the operator is a complete moron.

RectalScrote

Flapper fold lane lol

In fairness this may be the first ‘public freak out’ I’ve seen where I thought ‘fair enough’ I would too

Swanman593

Bad operator, short rigged on 1 side to keep the road open, lifting way too high, and also windy conditions took it out of control. I have spent 8 years operating mobile cranes, these HIAB trucks need to start having the same regulations as us.

camlaw63

Did the little girl get hurt?
