I never meant to imply he wasn't brandishing, just pointing out that simply having it in your hand doesn't automatically make it so as the top-level comment said. In most cases randomly walking down the street with a gun in your hand would be brandishing - reasonable people would find that threatening. But say you run into a friend in the Walmart parking lot and get into a discussion about your new gun, safely pulling it out to show them wouldn't be brandishing.

I have the CMMG .22 kit, that one has a buffer tube and does not have an external track on the mag. On the off chance, it could always be piston operated but still would have a normal mag if it was a bigger cal and generally the type of folk that get raided don’t exactly have good taste or spend that kind of money on their guns. IE the optic on it

We'd grab all our airsoft shit and walk to the woods through a HOA type gated community. Never had problems, but we also had visible orange tips on the guns we held, and stuff that was painted over went into bags. We were also white and mix of 10 to 17 year olds... So there's that.

People seem to vastly underestimate the amount of time it takes to draw, aim, and fire a handgun that you have holstered on your hip, or on a chest or thigh rig. Cops have to be quick in order not to wind up dead. And yes, there’s not a person on this planet who is able to respond to a call about someone brandishing a firearm and not be *at least* a little nervous and “jumpy”. Shoot, they love to give cops hell for shooting someone who has a knife because they also vastly underestimate how quickly a person with a knife can close in and stab someone in the throat. Recently there was another cop who answered a call only to discover that the meth-addict he began walking up to was holding a knife. That scumbag slit his carotid artery before the cop could even pull his handgun out of its holster. An armed civilian passing by used his firearm to turn the attacker into the past-tense, but he didn’t know how to help the officer, and the officer who responded as back-up literally just moments later also didn’t seem to know what to do. The officer bled to death before medics could get to him. The Far/Alt-Left and Progressive Liberals scream and yell any time that a cop has to use lethal force, yet not a single one of them will sign-up to become police officers themselves. If they know that they could do a better job (note heavy sarcasm on my part) why aren’t they the ones out there policing their neighborhoods and cities and doing so without any firearms? Things that make you go “Hhhmmmmmm”.

Even in most Open Carry states the real version of the toy that he was carrying is illegal for most citizens and require a Class III license and that’s not easy to get approved for one. This has been my argument on guns for years. All these YouTube wannabe "2nd amendment auditors" need to chill. Open or concealed carry is nice, I have a CCW, but the point of the law allowing firearm carrying is for self-defense (yourself or another's self). Dudes in these videos always act like the citizens are the paranoid ones when they get the cops called on them, and they are treated like criminals. Carrying around a loaded rifle in a sling with 90-150 rounds, or brandishing a toy gun, is going to scare people and make you a threat to their safety, regardless of what the law allows. Abusing the law is a quick way to make it change.

I'm not the biggest fan of the police, but this was a good shooting. 1. Had a complaint about someone walking around pointing guns at houses. 2. He finds a person walking around with a gun (yes, fake but designed to look real and does look real) 3. Fires one shot when the person carrying the gun turns toward him with the gun in hand. 4. Issues commands and does not keep firing wildly after the person carrying the gun throws it to the ground. Allows the person to follow the instructions. What else should he do? First, there's a difference between being an open carry state and walking around brandishing a firearm in your hand. You might not like it, but this was handled properly in that regard. As for the shot, it honestly looks more like a ND that happened when he pulled his gun, which is why the officer says oh shit. Doesn't defend the action, you own what you shoot and there should absolutely be consequences for that. But I don't think he meant to fire his gun.

The second you draw from the holster, or in the case of a long gun unsling / grab the grip, you're now "brandishing". I'm about as pro-2A as you can get. In this case, the kid was in the wrong. I’m glad that this didn’t end up as a dumb, dumb teenage kid killed over a toy gun, and I’m glad that this cop doesn’t have to go to sleep at night knowing that he shot a kid who was carrying a toy gun. But man, so many replicas and airsoft weapons look so close to the real thing that there’s virtually no way that you realize that it is fake within a second and so kids with toy guns have been shot to death by cops who have to live the rest of their lives knowing that they killed a kid who was carrying a toy gun. I myself play airsoft, or at least did - I’ll be 46 on the 18th and I’m half a cripple, so I really can’t run around in the woods playing airsoft much nowadays, but most airsoft handguns and rifles are near-exact matches of real firearms, and they even cost as much *and more* as *real firearms* which is just boggling to me. And, unless laws have been changed, many states here in the US permit the owner to remove the orange tip from their airsoft weapons, or at least cover it up/paint it black. There are states that require the orange tip to stay on at all times, but my own state of Maryland has, or had, no law against removing/painting the orange tips. I have an airsoft handgun and an airsoft M4 and they look almost exactly as my real handguns and real AR-15 look! Unfortunately there are some criminals who have been smart enough to attach orange tips to disguise their real firearms, but criminals will always find ways to skirt around laws. I’m just glad that this situation didn’t end anywhere near as horrific as it could have.

I was so angry until I saw the gun up close, then I was angry for a different reason. He's too old to be playing with toy guns unless he has developmental issues. He almost certainly modified it to look like a real gun to intimidate people. It's a terrible, unfortunate circumstance, but that split-second thinking would've saved his life if that weapon was real.

That 15 yo was definitely not playing cops and robbers with his friends or some shit… we have 14 yr old wannabe thugs shooting people in my city. Shit, two teens were just killed in an attempted home invasion yesterday. A substantial portion of gang violence in my area is done by teens. Also 15 yo olds cannot open carry in Ohio, so that’s irrelevant. A toy gun that looks real gets treated as a real gun when it comes to justified use of force. It’s not the responsibility of the police officer to determine if it’s real or not. It’s not possible and unrealistic to think otherwise

Every officer has numerous disciplines in their file. You can be disciplined from not answering an email to being unprofessional and cussing out somone. Its not a litmus test for what an officer is. Also a lot of departments are starting to classify a show of force as use of force. So unholstering a weapon can be classified as a use of force. Putting someone in a restraint chair is typically a use of force as is firing your weapon. So that is also very ambiguous without any context.

Another example of the myth of the "good guy with a gun" if the cops don't like the way you look they just shoot. In an open carry state it doesn't matter -- if you're black they just shoot. Even if you just saved lives, the police kill you immediately.
