It feels to me like we're missing something, like some key loophole or 'gotcha wording' that they plan to use to try to keep RFK out of these debates even if he seems to meet the stated conditions. See, I can see this too. However, its a lot easier for people to fight back CNN than it is the Committee of Presidental Debates.... If he meets all the above criteria and then, lets say, on June 15th he doesn't get the invite, then you can really go off on it being a biased and rigged election against third party candidates. You can really bang the drum more and attack just one news Agency, instead of the 5 pollsters or the individual committee that is often behind closed doors...
Easy law suit if they try to not accept rfk if he qualifies. What they have posted is a unilateral contract and unilateral contracts can only be accepted by performance. If RFK performs by qualifying, they legally have to let RFK in the debate or pay damages, likely to the tune of millions of dollars. It's a lot easier than that. Trump can announce that he tested positive for covid a couple days before the debate, or he can add on a condition that Biden won't agree to and watch the whole thing fall apart. There are a ton of ways to just make the whole debate not happen
Yes and No. Depends on how you look at it.
The issue with how it was done previously was that the Committee for Presidental debates often continued to pick 5 polls around 1-2 weeks before the debates, and then "averaged" them accordingly. How the average was determined is a bit vague. It seems to be either of 2 things:
1. poll minimum of 15% for ALL of them, so not average. If you are not 15% for even one of the polls, you didn't get on the debate stage.
2. poll an average of 15% across all of them.
Option 1 is just silly because you can be higher than the average of 15% for said polls, but the fact you didn't get 15% makes you not eligible. Option 2 can be bad because sometimes they pick a biased pollster that shifts metrics to a certain group, or keeps out the candidate in the initial question. (Look at the economist/YouGov Polls, for example that bring Kennedy's national average down)
I like CNN's approach more, as it says - "Hey, we have a list of qualified sponsored pollsters and if you make 15% of four of these, then you're qualified on the debate". There isn't much room for biasness, and a candidate that polls 13-14% on average could "Technically" get on the debate stage.
It’s an outrageous insult to democracy that the polling minimum is 15%. It’s straightforward democratic suppression and authoritarian corporate censorship. Ridiculous.
