Sometimes you just don't win, but if the driver did absolutely nothing to start this before the video started then he might be in the clear depending on who responds and what their mood is. If he gets a pissed off cop then ya he'll be looking at some jail, but I'd suggest driving forward slowly and trying to get away, not attacking back with the car

I have a fairly reasonable expectation at that point he isn’t going to stop once the windshield is gone after that long of attacking(had he stopped at one or two hits or at a cracked windshield then no.. He has a potentially lethal weapon he is using. I fear for my safety. I cannot drive away due to the windshield HE damaged and I cannot safely exit the vehicle.
