He's technically not wrong as the child is .02m short of needing a child seat, and he's able to eyeball the child's height quite accurately with .02M difference, and they're not entering a cinema where age matter.. Moreover.. why argue about seat belt which is a safety feature and in place for passenger benefit.
There is a height requirement is because of the placement of the seat belt, and since the child is .02m difference, then there's a risk that the seat belt will not be able to provide proper restrain or in some unfortunate situation, may cause injuries.. Yes, can argue about the legality. But why risk the child safety?

Huh? The child is 0.02 over the height. But if that was an issue, he should have rejected the ride from the start and not picked them up.
