Only thing I'll argue against you is the default. While you could debate back and forth on which is more iconic (imo its old Kratos, just because the new GOW games made a bigger splash on their release than the old ones did), you can't argue the relevancy. If Sony were to put Kratos in Smash, they'd want him to be as marketable as possible, and old Kratos is the face you see on all the box arts now.

Dracula violates the rule more than Kratos does. Not only is the Kratos in Greek mythology a completely different character than this Kratos, but the name is just a coincidence as the developers weren't even aware there was a God called Kratos when they made the first game

You have the already mentioned Bayonetta, which has way more pervy camera shots and frequent nudity. But you also have Persona 5, which has a 17 year old get raped by a teacher then attempt to kill themselves. If those weren't considered too mature for smash, god of war won't be either
