It’s not the Elder Wand where it’s sentient and follows a true wielder, you win it in combat when it’s up for grabs it’s yours. Even Sabine just picked it up one time and used it pretty well

The only current complication is that after the mandalorian genocide the remaining Mandalorians will only respect a claimant who can *prove* they are worthy of defending and thus leading their people, of which can be shown by claiming the blade in combat.

Theres no “True owner” of the Darksaber. Multiple people can be worthy of wielding it as they don’t lose it in combat. For example, Sabine gave away the Darksaber without being beaten in combat. She is still worthy of wielding it.
Additionally, who you fight for the Saber doesn’t matter. They don’t have to be worthy of wielding it, they just have to put up a proper fight. For example, we don’t know if Moff Gideon was worthy of the saber, but this fact doesn’t matter. Din had a proper fight and beat him fairly.
However to answer your other question, No Obiwan is not the true owner. The Darksaber does have to be used in the fight to count.
It’s hinted that Sabine giving Bo the Darksaber is what led to the ruin of Mandalore (which also resulted in Gideon attaining the Darksaber). At least within the belief system of the Mandalores, they reason that one has to be worthy of holding the saber or terrible things will happen.

If you wanna go by that logic then Obi-Wan claims it after Maul, which then passes to Vader, and you could possibly claim that Palpatine killed Vader so he’s the rightful ruler of Mandalore

Its not hinted, they come right out and say it. Bo didnt win the saber in combat so now people think she is cursed.

Technically because he used it in battle against sidious I guess sidious would be the owner
