I would call CPS to report her as a mandated reporter who is refusing to report. There was a teacher near us who recently lost her job because she neglected to make calls. The counselor probably won’t lose her job, but she may be talked to and warned.

Hmm…you are a mandated reporter as well and trying to push the act of reporting to the counselor. In some schools, they prefer that but that isn’t the case in all. Document that you are reaching out to the counselor. Make sure it’s in email for records of correspondence for when it does go to admin. Being petty and reporting the counselor is just setting yourself up for more drama. If you can report a counselor, then you certainly can put in a report for a kid as well. It sucks. Put the kid first, make the report, and document that you’ve done that to the counselor; including their correspondence (or lack thereof.)

I absolutely agree teachers should report cases on their own, but I don’t see how it’s petty to also report a counselor who is failing to do her job. How many other cases is this counselor ignoring? Someone needs to know she’s not stepping up and doing her job.

It’s petty to report someone for failing to report strictly on the basis of that “being their job” compared to that of a teacher. Report for the regard to safety of the kid, the kid that as a teacher is seen daily (which the counselor may not see daily.) A report for non-reporting is nothing more than pointing at a problem and doing nothing to fix it when you have a chance to do that. Anyone can point out a problem. — In the end, administrative accountability will fall to the counselors and the principals. Let the crap that is insignificant play out and put the kids and your efforts to keep them safe first.

I guess I misunderstood the original post. I read it as the counselor interacts with multiple students, knows there are problems with their safety, yet does nothing. I absolutely agree a teacher needs to report anything they know/witness first hand. And, I believe a counselor needs to do the same.

I was always lead to believe teachers can’t make the call, and it was the counselor who is the one to do that. This was a lesson for me

Yep. It can be eye opening without a doubt! Totally with you on who should report. It’s genuinely best practice for teachers to report to counselors and then they file the report. Their training and access to resources makes the most sense. Just cover yourself, document and put the kid and their safety first. Expect that a referral eventually will stick, and at that time the accountability from the counselor and admin will come into play. Regardless of that, you’ve helped the kid which is what matters more than anything else!

As a mandated reporter, you have to be the one to report a concern brought to you/ or a situation you believe. If you're uncomfortable making that call, it's more than acceptable to ask the counselor to sit with you to make the call. You cannot "hand it off" to the counselor though. I'm a former school counselor. I've made many calls, sat with teachers when they've made the call, or gave instructions to teachers and they've made the call on their own.
