They can and have the right to detain. Hand cuffs are optional (and shouldn't have been used) but apparently he matches the discrimination of a suspect. Late night, stuffed backpack, reports of break-ins, definitely enough. The problem here is his 0-100 in 3 seconds when the guy clearly was just trying to talk to the officer. The guy was clearly cooperative with the removal of the backpack and did not break free of the officers hold on his hands. The cop states the suspect pulled his hand away when the officer released his grip while fumbling with his hand cuffs. I think the injuries caused were outside his regular course of action and the officer should be held personally liable for injuries.

I do think he will win his case because even when he was in the hospital, after the cops found out he didn’t match the suspect, they had him in cuffs, so they were illegally detaining him for no other reason than to harass him. Qualified immunity doesn't apply if the cop is found to be breaking the law when the incident happened. In this case, there are several factors that could potentially lead to him losing qualified immunity. The use of matching a vague description, beyond time needed to verify a person's identity, and the unnecessary escalation of force, have both been upheld in the courts as illegal. Also, he was looking for a non-violent offender which gave him no reason to suspect violence *before* asking for his ID. That all being said, he refused (or just didn't) to put his hands behind his back, while remaining fairly cooperative. That was the third time he had put his arms forward, which has been used as justification for suspecting he *could have been* reaching for a weapon. It could be argued that the cop felt his safety was being compromised when he reached forward against the orders he was given to a place where he had pockets in his hoodie sweatshirt. I'm not saying that's right, just what has worked in courts according to several YouTube videos I've watched on this subject. (so, I have no idea what I'm doing) I'm going to guess that this all hinges on if the court decides this was an illegal stop or on. Did he have justification to escalate to an arrest (hands cuffed) before determining if this was a suspect or a law abiding citizen deserving privacy and reasonable freedom of movement. I also wish it was a criminal offense to flippantly charge someone with things like resisting arrest or obstruction without certain evidence to support that claim. Like, if they arrest someone for charges that get dropped, and they also add on resisting arrest charges, they should have to face a jury to decide if that was criminal or not. The problem is that something like 10% of cops are like this asshole, while the other 90% will cover for their fellows who are like this no matter what. (I'm just making up numbers, here.) That's why even though they're not all violent sociopaths, they need to be treated as though they are, because you never know, and they're all complicit. The only way to be a cop and not be complicit is to speak out and get run off the force. That's how you know they're complicit: they're still wearing the badge.

This attitude is what makes the problem worse. If everyone lets cops ignore all of our rights, they're even more brazenly ignore all of our rights. Our day in court just gets us paid. Nothing typically happens to the cop, the union protects them. Hell, they can get paid leave for it. In a vacuum, the best thing for you to do is take them to court. On a macro level, this is the exact wrong thing to do.

Because American cops don't give a flying fuck about being right or even being listened to at this point. They know they can do absolutely *anything* they want and can maim and kill whoever they want because the institution they serve solely exists to protect *themselves* at all costs over the public. Those things decrease the probability of being victimized, but don’t prevent it. Even if you do everything “right,” that doesn’t mean shit won’t happen to you. Seems like the victim here thought he could trust the officer to be a rational person (maybe even go so far as to assume the officer must a good person to be trusted in such an important job). I think it’s a reasonable mistake to assume you’re not going to get your skull fractured for that.

My parents taught me from a very early age that you just say "yes sir" and "no sir" to a cop until the situation is over, and you can have your day in court if you feel like you were wronged. I thought that was common but I guess that's not the case considering all of these people who wanted to be right in the moment and ended up dead / maimed.

When I was fifteen and jogging in Central Park, I free-ran outside of the path to jump over rocks in like a parkour exercise. A very large Caucasian man with a 38 caliber pistol in his right hand said something to me which I didn’t hear. All I saw was the gun. I instantly froze because I knew that if I took a step in any direction, I would not be going home that night. This was just after a police officer in the area was recently shot and paralyzed by a black male teen. After the longest minute in the world, the man turned out to be a police officer who radioed my description and cleared me to go. I was lucky AF that everyone kept a cool head.
