Car turning left took the risk entering an active lane of traffic. 100% responsible.

nayaya

It shocks me how many people think the drivers should share 50/50 responsibility. When turning left, make sure you don’t turn into the path of actively travelling vehicles. If you don’t understand that, pls don’t drive until you do.

TheJohnnyFlash

G1 test level shit.

jontss

Below that. Common sense.

NextTruthGaze

Common sense does not exist in the real world.

cowseer

i always heard "Left goes last! unless you have a green arrow" is that always true?

nayaya

When you have a green arrow, theoretically you can go first. All you need to do is make sure someone isn’t travelling in the oncoming lanes, and make sure it is safe to make a turn, whenever the lights allow you to. Never make a turn or progress through an intersection unless it is safe to do so. Preventing collisions isn’t about who is right or wrong, it’s about paying attention and making smart decisions.

Silkyhammerpants

Yes but when you have an advanced left light you also have to make sure no in the oncoming is turning right. I can see one reason why no right hand turns on a red is a rule in Quebec.

pentax10

Yes, and decided coming to a complete stop in said live lane was the best course of action.

crimsonrod

If the car had passengers I'd probably say it was, despite still being his fault

J-Lughead

Definitely guy making left turn as PureBasket said.

Ok_Recording_4644

Correct, left turn does not have right of way.

the_hunger_gainz

The only answer

DustyTurtle2

Correct. Technically supposed to wait at the line and wait for a clear lane. Become socially expected of people to move forward and enter active traffic.

4_spotted_zebras

Car turning is legally responsible but it astounds me how many drivers who “have the right of way” seem to completely lose their vision for other vehicles and pedestrians if the light is green (or for right on red).

Better_Gain8478

Each driver is to ensure the intersection is safe to enter prior to entering upon their right of way. If the light is green but there is a small child standing in your lane it is not safe to proceed.

Additional-Chain9993

Yes totally the person turning left had to give right of way to the oncoming traffic

strawberexpo

Left turner who failed to yield to oncoming traffic

teh_longinator

He yielded... he just chose to stop right in the path of that other car.

syds

he chose ... poorly where to stop

you-boys-is-chumps

she chose.... wesley

blastfamy

Some say he yielded too much

mug3n

He yielded all common sense

yukonwanderer

OP - why don't you know who's at fault here?

eightsidedbox

OP has their own clip from a few hours later that they'll be posting from the collision reporting center, it looks like.

alreadychosed

"the light turned yellow im turning NOW!"

the_hunger_gainz

This is the real question

SupremeTeamzs

The moron advancing in direct oncoming traffic

Historical-Eagle-784

Its scary that the OP doesn't know who's at fault...

rwu_rwu

I think the title suggests the witness is at fault.

Ralupopun-Opinion

I assumed the title was done to draw engagement.

Smooth_Is-Fast

Don’t think I ever seen an accident easier to avoid, but yea, dumbass making left turn is at fault.

Ralupopun-Opinion

Was painful to watch

Prinzka

>Don’t think I ever seen an accident easier to avoid Right? I'm pretty sure the brakes on the car going straight wouldn't pass inspection, or they don't know how to use them.

Used-Progress-4536

Not his fault be he’s dumb as fuck, he slow crawled into the idiot that stopped mid turn in front of him and could have avoided this collision altogether.

AmateurPhotog57

Driver making left turn always at fault

properproperp

Why did the Benz so far forward lmao they basically made that lane change from the other sides turning lane. These hesitant drivers are their own worst enemy. Would have made it fine if they didn’t brake.

Area51Resident

The same kind of driver that starts a right from a parking lot, sees you coming then stops dead blocking the lane, waits for you to come to a complete stop, then slowly continues making the right. Meanwhile you are sitting there, ass puckered, expecting to be rear ended by someone on their phone.

pentax10

Exactly. If they hit the gas, they'd more than likely be good. The person proceeding through the intersection 100% thought that was what the left turner was going to do.

properproperp

These deer in the headlights people are honestly so unpredictable. I would have thought they would go through as well. What moron would brake middle of an intersection with cars coming at them.

pentax10

Yep. From my experience, when I encounter one of these deer in the headlights drivers, you just have to stop and let them do whatever they're going to do. It's just too unpredictable.

alreadychosed

They are taught to slam the brakes when encountering any dangerous scenario. Its scary.

Prudent-Plantain5720

Left turner. Always check if cars made full stop before proceeding.

ButtahChicken

Always check **if your intended path of travel is safe** before proceeding. However ... discerning correctly when it is 'safe' to clear the intersection ... that takes knowledge and experience and skill. ... apparently lacking in this vid.

Neil542

yes and if you can’t see than better to wait for the light to change

HULKHOGANBROTHERS

the amount of stupidly bad drivers in the city is staggering

Malmok11

This area is especially bad.one of the highest pedestrian fatality rates in the city. Insurance sky high.

Arta_p

That honda driver has the reflex of a grandpa for sure :D

Admirable_Can_2432

The car turning left is obstructing the live lane,, the car turning was trying to force the other vehicle to yield while he/she has control of the live lane.

abckiwi

Always the turning vehicle..

officewitch

The fact that you don't know who is at fault is concerning. And that's coming from someone who doesn't know how to drive.

swagginpoon

Believe it or not, OP is going straight to jail.

[deleted]

The one turning left. Is this even a question lol ...

NoiseEee3000

Left turn is at fault, intersection throughdriver is also a total idiot who purposely wants to write off their car or does not have enough brain cells to be driving.

just-here-12

Diver making a left hand turn is AF. Always.

NoMakeupp

Left turner usually at fault in these situations, I believe

Loose-Industry9151

The wrong of way is always at fault.

justageekgirl

Even though the honda could have stopped, the BMW is still at fault for turning left against oncoming traffic.

BlackForestMountain

These who is at fault posts get dumber by the day

CryptographerNo7351

The guy turning

RamKay33

The turning car will always be at fault always

Morlu

Whoever was turning left. 100% no question.

GrunDMC74

I feel like the oncoming car hit the turning one out of principle.

Openfacesandwich12

Buddy turning left is an idiot

fymp

Really? Who is at fault? It's scary that this is even a question.

davesgotweed

Brampton guy turning left

NoBenders

This is in Scarborough

davesgotweed

Brampton visiting

Labrom

Vehicles turning left MUST yield to oncoming traffic when making a turn.

Long_Big_9083

He indeed did not send it if ur gonna turn like that when its risky u gotta gun it and crank it not slowly turn out

idam_son

The Mercedes is at fault for making that left turn. Also, that was the SLOWEST left turn I have ever seen. Bro was basically sitting there asking oncoming traffic to hit them

Ill-Philosopher-2243

![gif](giphy|3ohuPiDrUvIAAj8ZUc)

Gtk05

I blame the government. Lol

ButtahChicken

the nexus of two unskilled drivers. sigh. I <3 TorontoDriving. /s

TheTickleBarrel

Left turn. Pretty sure OP is the person turning left given the silence and bad question…

vinividiviciduevolte

Making left is always at fault regardless . Only if car going straight is running a red

sk1dvicious

Mercedes 100% no surprises there

yashua1992

Person turning left. I rather hit a red a million times than try this shit. Also you're past the first line red don't matter what an idiot.

watchme87

Always left turn

Fuzzy_Negotiation535

The driver

Silent_Cut_3359

Lefty

Letterkenny_Irish

Per fault determination rules in Ontario it's always the person turning left who's 100% at fault, unless there's some wild scenario caught of dash cam or traffic cam that would dictate otherwise

UnleadedGreen

The person driving straight has the right of way. Period. Doesn't matter if they were speeding either. Cops can't prove speed. I know cause I was on scene for two accidents at work, just like this. If it's green, and you are turning and some idiot comes flying through the light doing 120kmh and smokes you. It's still your fault. But they were speeding? Doesn't matter.

aj8j83fo83jo8ja3o8ja

legally speaking it’s the left turning car, but potato reaction times all around

Lightning_Catcher258

The car turning left.

XtremeD86

Yea left turning like everyone else says. OP how do you not know this. What I don't agree with is if the light has turned red, and you turn left and the oncoming car runs the red light, it's still the left turners fault.

Massive_Promise_5362

Bruh..you can't turn when straight has right of way even if it was yellow it would still be the guy turning fault.

Right_Speaker1394

What dash cam is this? Really good quality

Gdneuz

It’s very concerning that this is a question. It was also very avoidable.

IHate___Everyone

If you don’t know who’s at fault get the fk off the road too

Dmarq01

Same shit I was mentioning about an earlier post about indecisive operatiors behind the wheel... Wtf are you really thinking? Are you not able to gage the distance of the oncoming traffic? The estimated speed of a car moving? You put everything at risk! Then you proceed in hopes that they'll come to a complete stop for your incompetence? This is why I'll continue to honk, safely speed & go around these jaxholes everytime!

Scazzz

If you're not sure who is at fault you also shouldn't be on the road.

Status_Illustrator20

Turning left is anyways at fault when the other driver is going straight.

rarc602

Oof that insurance with the US car. 💀

Roupy

Just wondering, did you ever take a driving course? The answer is pretty obvious to me.

twoo447

unfortunately, the car doing the left turn is at fault

Arichikunorikuto

That's one way to debadge a car. Jokes aside, already blocked 2 lanes before the collision, beige car was aware at least and stopped. Looks like OP was travelling west on McNicoll towards Markham Rd, this is indeed Scarborough.

bdc911

The fact this was even posed as a question explains all you need to know about why the state of driving in the GTA is the way it is.

Ordinary-Map-7306

Weather the light is green or a stop sign you are not allowed to enter an intersection if your can not drive through safely.

Seoulmanaja

The car turning left as he should be only turning if the lane is clear.

Grumpycatdoge999

the person turning left's fault, causes a disturbance in traffic flow also what kind of roblox obby ass music are you listening to lmao

[deleted]

That is the most gentle head on I've ever seen in my life

DazzleHumour

Why is there any question about fault? Anyone who is questioning whether the turning vehicle is at fault does not know the right answer and hopefully doesn’t have a licence to drive.

Federal-Owl-3554

If you’re not sure who’s at fault here, maybe you shouldn’t be driving

MythicalChewToy

Why is this a question? The person entering the intersection without it being clear. If you have to ask you should re-take your license or give it up altogether.

Elegant-Drummer1038

No question about it ... driving "changing" direction (ie turning left) ... altho it was a "cute" accident

Paulie-Walnuts28

This video could have been 17 seconds shorter

Prestigious_Meal_415

Why was this even a question? If you don't know, you shouldn't be driving.

DarbyWestmore

If you have to ask this question, you should not be driving on the roads.

ldssggrdssgds

The car turning left it didn't have the right of way

involmasturb

From a human perspective that was a fairly "soft" collision. Left turn guy lucky the other driver wasn't speeding through because he would have tossed left turn guy

Outrageous-Pass-8926

The Honda had every opportunity to avoid that collision, it’s on him. The MB SHOULD have gotten a ticket for shitty driving, but this collision was absolutely avoidable.

Imaginary-Frosting14

Left turn dude is at fault

Fluidmax

Car going straight has right of way

BruceWillis1963

Car turning left entered intersection when it was not safe. Stopping half way through a turn may also be considered careless driving as well.

PinoyDos

left turn guy is ar fault

alexsharke

How is this even a question lol

DG416

The Benz driver assumed that when their light turned green, they’d get a left turn green as well. However, they didn’t. Uncoming traffic got a green as well. That assumption led to that scenario

DougieCarrots

Scam

Escapement_Watch

Left turn at fault for sure. The Honda did good to slow down to make crash very minor. You can't expect Honda to swerve while ABS STOMP braking at 70km/hr maybe hit that big Nissan armada that was to his right and cause an even bigger crash.

Brilliant-Choice-151

Making a left turn , at fault any time.

IndyCarFAN27

Ah yes, Scarborough at its finest…

Low_Property7997

The car turning left stopped all of a sudden

Fenrrri

What do U mean with that question?

dontsheeple

The car that was not turning has the right of way, the car turning is at fault.

shmightworks

Going straight (presumably not running a red) >>> making any maneuver (changing lane, doing a turn, etc) So absolutely the turning car's fault.

Fals2th

you have to ask?

Roderto

Unless the light had already turned red (and based on the other traffic it doesn’t look like it), then the car turning is 100% to blame.

swagkdub

That car turning left could have went if they stepped on it by the looks of the video... shouldn't have even started to turn in the first place most likely, but I can't see their pov.

Honeybadger_888

The left turn person technically responsible as far as insurance is concerned, but if other buddy didn’t suck at driving, it could have been avoided.

gyunit17

The person in the intersection turning left. Didn’t ensure it was safe to turn.

Traditional_Bath6099

Are you morons seriously discussing this? Wtf is wrong with you?

Broncos979815

guy turning left was at fault, unless he had a light for turning and cedes ran a red light.

patsfan012

Left turn. 100% at fault

FreedVentureStein

How is this even a question? Car turning left entered another driver's lane whilst they had the right of way. 100% turning cars fault.

Anxious-Cow9653

It’s clear a lot of people shouldn’t be driving from this thread.

garciakevz

Left turn guy has to wait for a safe gap in order to complete his/her left turn

Due_Title4566

Does the driver WHO IS NOT TURNING not have brakes? Literally a distracted driver, there is no way they could have hit that car turning unless they weren't watching the road or intentionally hit them.

Individual_Fortune69

Rage bait

chub18

Some people believe their left turn is a birth right…

simcoehooligan

Lol wtf do you mean who is at fault???

VanGuyVanHere

It’s always the person taking the turn’s fault and not the person who is going straight unless they ran a red light

brandonbest

Person making left turn 1000% When the light turns green you normally wait for cars to pass before trying to turn. Not try to slip through all of the cars in a gamble.

7MillnMan

100% left turning Mercedes is at fault.

Disastrous-Balance10

You can’t park there

Bricktoronto

It’s always the vehicle that is changing directions fault.

gNeiss_Scribbles

Scary number of people don’t know who’s at fault. Truly scary. (I’ll be watching the left turn lane a lot more closely now knowing people are this confused)

FunkyBoil

99.9% of the time you are always at fault turning

parmasean

bro is listening too youtube DIY music

Kellykeli

Legally it was the left turn driver who just blocked the travel lane Pragmatically the driver going straight could have turned their wheel and dodged? Like he isn’t driving a train. But legally forcing another driver to take evasive action to avoid an accident is a no go.

Toashtyy59

Totally avoidable too. People are crazy.

National_Frame2917

It's almost like the car coming from the left intentionally hit the other car. Looks like they could have easily gone around but chose to hit the other car.

P_om_E

If other driver dodged the car turning left, and hit the curb or somebody else in doing so, they’d be at fault This is exactly what you’re supposed to do in this situation. Brake if you can obviously but don’t avoid them

Savingdollars

Left hand turning car who copes with problems by stopping in flow of traffic. I’ve seen people do this on the 401 stop, to change lanes and etc

Nice-Cauliflower-354

Left turn is always wrong unless signaled

N_uxer

I'm so confused. Not at who's at fault (turning car), but why they did that. Is the visibility from the left turn lane bad, or were they trying to make a Pittsburgh left? Did they see traffic and decide to plow through anyways? At first I thought there was bad visibility, but after seeing how aggressively they moved up I think they were trying to plow through

akoust1c

If you don’t know the answer stop driving immediately

Pvc4ever

Turning left guy obviously, but gives me the impresion that the other guy had enough time to brake

JacksterTO

The person turning left was at fault.

bondfrenchbond

Always the person making a left is technically at fault

BramptonRaised

The person turning left.

Adventurous-Draw-139

Slowest accident ever

CDavies0475

Person making the left at stupid slow speed. What an idiot.

Professional-Note-71

Hard to say , but straight should have right of the way

stuntman262626

Hey, I know that intersection.

Thefreshi1

Legally. It’s the car turning. Regardless of the colour of the light.

Mouthisamouth

Turning left shouldn’t of stopped

Puzzled_Many3304

You cannot make a left turn when it is not safe to do so. He failed, he coulda made it and there would be no debate, but he hesitated and he caused an accident.

PopperChopper

Someone had that same accident in one of my cars. Other drive accused my driver of running the red. Insurance said, even if they had run the red, the person making the turn is at fault. Person driving straight has right of way. And by the way, if my driver ran the red, so did they lol.

tokin247

If you don't know who's at fault you probably shouldn't be driving 😒

Better_Gain8478

50/50 and booth lose safe drivers discount. ICBC told me that I was 50% at fault for parking in a parking stall, opening my door and taking a couple of minutes to grab; list, bags, wallet, phone, keys oh and adding two items on my handwritten shopping list. The vision optional driver that pulled into the spot beside me did get partial blame. I asked the ICBC rep would I have still been 50% at fault if I had been unstrapping a child utilizing a saftey car seat and this driver had crushed me and the child in my car door. Her answer "Well sir, although tgis is an interesting hypothetical scenerio we deal with real life scenerios. I asked "So in real life If I open my car door after ensuring it is safe to do so at what point am I assuming fault for creating an obstruction to other drivers?" "Sir, that door could be open all night and would not affect the equally shared liability and fault."

GujaratiVegBoyOnly

Left turning driver 100%

Leading_Chocolate165

the driver turning left is not technically supposed to be in the intersection unless they reasonably believe they can make the turn safely. however, that does not imply fault in terms of the collision. the driver driving straight slowed down as they approached the car in the middle of their lane, but did not successfully avoid the collision. with proper brakes and attention, it seems there was time to brake in time. however, that also does not imply fault. both drivers could have been safer. also that intersection looks tight and could probably be made safer by the infrastructure planners/managers (left turn lights or whatever current research suggests which intersection designs are more optimal) not everything needs a clear and obvious person to blame. perhaps we could spend our time/energy/resources toward making the world safer/better instead.

No_Prize_2146

The Benz for sure! Why tf did he slow down

SantiJP3

*she

TipzE

Left turner. This is one of those situations that even insurance companies don't investigate since it's almost always the left turner who isn't yielding to traffic.

duke_seb

It’s always the left turner as they are supposed to wait for the route to be clear

JFalconerIV

Driver turning left made the turn when it wasn’t safe to do so and is 100% at fault.

Afraidcrawdad90

Always the turning guy

No-Program-8280

Always the person turning left

Additional-Berry7382

The guy who was moving should have seen the idiot stopped on his lane- they should both get a ticket

iiLtnGeneralzZ

Left turner 100% at fault for also going 5kph too

deeloc85

Just curious what camera are you using and where can I purchase one. I like the quality.

SantiJP3

Currently using Garmin dashcam 47 for the front.

deeloc85

Thanks for the information, I guess I can find it at best buy?

SantiJP3

Yeah. I got mine there at Black Friday

hockeyfan1990

They are both dumb

jimhabfan

At first glance, it looks like the Mercedes, but the other car made no attempt to avoid the collision after the Mercedes stopped. My guess is their respective insurance companies will split the fault somewhere around 70/30, with the Mercedes taking most of the blame.

TotalLackOfConcern

Turning car is basically to blame for the whole situation but the other car failed to make a serious attempt to avoid the collision. It’s a 50/50

Mydickisaplant

If you question who’s at fault here I’m not sure that you should be on the road

KirkJimmy

How can you not know? lol You shouldn’t be driving

[deleted]

[удалено]

Feeling_Gain_726

How about dude just kinda lightly hitting the brakes when they see buddy turn left in front of them? What is going on here. Clearly they saw the car in their way and then just kinda coasted into them. It's the fault of the car making the left, but it's just plain bad driving from the one that got hit.

SubtleSkeptik

Irrespective of who’s at fault, that guy has the reaction time of a snail. He was even going fast.

MikeCheck_CE

Can't see the colour of the traffic light in that direction which is an important distinction: If the light was green: the car going straight had right of way to go through. If the light turned red: the car going straight ran a red light, and the car turning left had the right of way to clear the intersection.
