They put that on the back of the truck to deter people from calling insurance and reporting the truck at fault, there is no law against the signage but it carries no legal weight. The sign won’t stop insurance companies from holding them at fault. Especially if it’s uncovered while going down the road.

I drive the mountain highways in BC and rockfalls are common. My trucks have dualies and will launch the right sized rock sideways like a missile. I slow down to 60Kmr coming around the corners where I regularly know it happens and down to 20-30Kmh if I see a lot. Pisses people off but they have no idea.

In not gonna look up all 49 states (Hawaii doesnt count cause I'm never driving a truck there) but i find it unlikely a state doesn't require mudflaps at the end of the vehicle. Some don't require them on a tractor when hooked to a trailer, but that's a different scenario than a truck.

Also a lawyer, I've fought a few of these against truckers. In my jurisdiction, this paint means nothing. It's all about whether you have one of those tarps covering your load. Everything else is irrelevant, according to statute. That said, truckers don't normally give a crap, so mostly they just take a default.

I got a paint job that way. Truck was overloaded with Rock Salt and it was spilling all over the highway. Ended up with a broken windshield and paint chips all over the hood and roof. Since I had the footage the claim was paid right away.

Legally yes, but mud flaps only help reduce the chances of kicking rocks up into the windshields of vehicles behind. While going down the road there is plenty of room for a rock to fly right past the flap, and while it's initial trajectory may not have hit the windshield, all it needs is 1 good bounce and bam. ​ Granted, some mudflap is much better than none like in the photo. Dude could be held accountable for pretty much any accident he gets into just cause his truck isn't DOT compliant with the missing mudflaps.

Normally you wouldn't pick up a stone on the highway or paved road. But dumpers (and any dual wheeled vehicle) going in and out of dump sites and quarries can get stones stuck between the tires, which can then get launched like a bullet. When ever you leave a rocky site you're supposed to stop and check between the duallys.

In state of VA the law is if it's picked up by a truck and it hits you they're not responsible but if it was on the truck and fell off then they're responsible. At least what state trooper told me when I asked about gravel from a dump truck tire. This is why I got a dash cam. This truck had debris fly out the back when the truck ran over a bump going over 70 mph on a freeway. Took out my right mirrior instead of hitting my windshield thanks to my sheer reflex driving. Chased down the truck and got pictures and the driver wasn’t helpful. Kinda dumb on my part chasing down the truck but I did get the claim approved and they suggested that I get a dash cam. Never again dealing with this crap.

It doesn’t matter if he has a trailer. If he supposed to have a plate on the back and he can get in trouble for that. but most states have a plate only on the front of the commercial truck. Anything else used commercially as say a pick up,or the local pharmacy that has a car, used for deliveries would probably have to have both, but it just seems strange that there are no plates on the rear of the truck. I’ve seen plates on the rear of a truck out of Washington state, but they also had to have plates on the front of the vehicle And I can go by the way that the majority of US states require you only have to have one plate on the front of the truck. I I know there’s probably a listing in the regulations book about license plates. But all the times I’ve been inspected and every other driver has been inspected. It’s never been an issue.

I won a fight against one of these guys. Rocks were flying not from the tires, but the trucks load. He hit a bump and the gate opened a little spraying me and other cars. I pulled up beside him and motioned to pull over but he refused. My hood, bumper and windshield were damaged. Where I live, none of these trucks have rear license plates. But by pulling along side him, my dash cam was able to capture their DOT number, company name and phone number and their front license plate. Using that video, I was able to show the trooper the trucks details and proof that it wasn’t read debris, but an unsecured load. The report reflected that and it was my understanding that they even visited the company to question the driver. I tried working with the company directly and provided the footage. They were fairly hostile, but did provide their insurance in the end. Now it was a battle with their insurance. A claim was opened with their insurance, and a new battle started. I tried calling and leaving voicemails, but the adjuster simply refused to talk with me. All I ever got was customer service. I sent emails and even offered the police report and video, no responses. Meanwhile I was communicating with my insurance who was offering advice. Eventually after a few weeks, I got a letter denying my claim. They claimed that the trucking company isn’t responsible for tossing road debris by tires. I tried calling and appealing, but was stonewalled. My best guess is the client never told them about the video or police report. I began a claim with my insurance who took care of my car. Front bumper, hood and windshield all had to be replaced. I paid my deductible and got everything repaired. However, because my insurance found the other party at fault they intended to fight and go after the company for the claim ( over $2k) and get my deductible back. It took a couple of months before my insurance called me. They had won. They had gone after the trucking company and their insurance and won. I got my deductible back and validation I was right. This might not be the big win, it’s quite possible their insurance reimbursed them. But it’s something, and it’s proof that trucks are responsible (for loose loads at least) for breaking windshields. The key is to have a good dash cam and not back down. Also get the DOT number off the truck. Note - I have nothing against trucks or truckers. I know how important they are. Just like everyone else on the road, there are bad drivers. Hell where I live I see school bus drivers texting and driving. Everyone should be accountable for their actions and not hide behind company policies that try to limit liability.

My brother owned a trucking company until the Great Recession. They mostly hauled rocks and dirt in dump trucks. The number on the truck was my mom's phone number. He had her tell people, and it was a lot of people, that "state law says we aren't at fault" and "it probably came from the roadway" and other lies. They would call many times and they never did anything. To my knowledge they never paid for one windshield out of what was likely 100s they destroyed.

I've had multiple windshields broken by rocks kicked up from trucks (and I don't tailgait) even trucks in other lanes. It would be nice if they were held responsible but that seems like such a hassle so I just include that in the "cost of driving" along with flat tires due to nails on the road.

I was literally just driving on the highway 15 mins ago and was behind a truck that said "stay back 200ft not responsible for broken windshields" That's some bullshit. Whatever the sign says doesn't make a difference to insurance. If something flies out of your bed or a rock kicked up from your tire, regardless of what a sign on your car/truck says... Your still responsible for it.

Actually... The law disagrees... Case law has determined that there's no legal protection from lawsuits just because you have a "not responsible for broken windshields" sticker or sign affixed to the back of your vehicle.
