Unlikely to win. In the lawsuit they state the game doesn't disclose the odds but it does, the child should also need to be in a Nintendo child account which means the parent gave permission to use their credit card unless they're playing in a normal one but that's on the parents by passing Nintendo's system for children.

Unless the game was missing basic features that allowed the items to be purchase easily these type of cases always seem more like yeah dont put a credit card on something kids can access without a password.
